Ordinance No. 6,405921022 -13 ORDINANCE NO. 6405 AN ORDINANCE AUTHORIZING THE PAYMENT OF THE SUM OF ELEVEN THOUSAND FIVE HUNDRED NINETY -ONE AND N01100 ($11,591.00) DOLLARS TO ASCOM TIMEPLEX AS THE SOLE SOURCE FOR THE TWELVE PORT MULTIPLEXOR FOR LINKAGE BETWEEN STERLING MUNICIPAL LIBRARY AND THE HOUSTON AREA LIBRARY AUTOMATED NETWORK (HALAN); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Sterling Municipal Library is in need of a twelve port multiplexor for linkage with the Houston Area Library Automated Network (HALAN); and WHEREAS, TEX. L. GOV'T. CODE ANN. S 252.022 provides that when the functional requirements of the City can only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the procurement of the twelve port multiplexor for linkage between Sterling Municipal Library and the Houston Area Library Automated Network (HALAN) can be satisfied by only one source, Ascom Timeplex, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that only one source can satisfy the needs of the City for, the twelve port multiplexor for linkage between Sterling Municipal Library and the Houston Area Library Automated Network (HALAN). Section 2: That payment to Ascom Timeplex, as the sole source, of ELEVEN THOUSAND FIVE HUNDRED NINETY -ONE AND N01100 ($11,591.00) DOLLARS, for the above - described twelve port multiplexor is hereby authorized. Section 3: That pursuant to the provisions of TEX.L.GOVPT.CODE ANN. S 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 ($15,000.00) DOLLARS or less, subject to the provision that the original contract price may not be increased by more than twenty - five (25 %) or decreased by more than twenty -five (25$) percent without the consent of the contractor to such decrease.
