ORDINANCE NO. 6372
AN ORDINANCE ACCEPTING THE BID OF MIRACLE RECREATIONAL
FOR TEXAS, HUNTER KNEPSHIELD CO., AND PERSENAIRE PARK &
PLAYGROUND PRODUCTS, INC. FOR THE PURCHASE OF
PLAYGROUND EQUIPMENT AND AUTHORIZING PAYMENT BY THE CITY
OF BAYTOWN, THE SUM OF FIVE THOUSAND FIVE HUNDRED THIRTY
AND 75/100 ($5,530.75) DOLLARS; MAKING OTHER PROVISIONS
RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, the City Council of the City of Baytown, Texas, did
authorize the Purchasing Department for the City of Baytown to
advertise for bids for the purchase of playground equipment to be
received September 16, 1992; and
WHEREAS, notice to bidders as to the time and place, when
and where the contract would be let was published pursuant to the
provisions of Section 74 of the Charter of the City of Baytown;
and
WHEREAS, all bids were opened and publicly read at City Hall
at 2:00 p.m., Wednesday, September 16, 1992, as per published
notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of Miracle Recreational For Texas for Item
No. 1 of playground equipment for the sum of NINE HUNDRED FIFTY
DOLLARS AND N01100 ($950.00) DOLLARS, and authorizes payment
thereof.
Section 2: That the City Council of the City of Baytown
hereby accepts the bid of Hunter Knepshield Co. for Item No. 2
of playground equipment for the sum of ONE THOUSAND TWO HUNDRED
FORTY -THREE AND 75/100 ($1,243.75) DOLLARS, and authorizes
payment thereof.
Section 3: That the City Council of the City of Baytown
hereby accepts the bid of Persenaire Park & Playground Products,
Inc. for Items No. 3, 4, and 5 of playground equipment for the
sum of THREE THOUSAND THREE HUNDRED THIRTY -SEVEN AND N01100
($3,337.00) DOLLARS, and authorizes payment thereof.
Section 4: That pursuant to the provisions of
TEX.L.GOVIT.CODE ANN. § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND N01100
• ($15,000.00) DOLLARS or less, subject to the provision that the
original contract price may not be increased by more than twenty -
five (25 %) or decreased by more than twenty -five (25 %) percent
without the consent of the contractor to such decrease.

• Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
