ORDINANCE NO. 6328
• AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED
THE SUM OF SIX THOUSAND AND N01100 ($6,000.00) DOLLARS
TO CHEMICAL WASTE MANAGEMENT, INC. FOR THE TURN -KEY
ANALYTICAL TESTING OF UNKNOWN MATERIALS IN SIX (6) 85
GALLON OVERPACK SALVAGE DRUMS LOCATED AT 1210 PARK
STREET; MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, six (6) overpack drums located at the Parks Service
Center require analytical testing in order to obtain a quotation
for disposal of unknown substances; and
WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in
case of procurements for the protection of public health or
safety, the requirement for competitive bids is not applicable;
and
WHEREAS, informal bids for the turn -key analytical testing
of unknown materials in six (6) 85 gallon overpack salvage drums
located at 1210 Park Street have been obtained, and Chemical
Waste Management, Inc., is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Chemical Waste Management, Inc.
in an amount not to exceed the sum of SIX THOUSAND AND N01100
($6,000.00) DOLLARS for the turn -key analytical testing of
unknown materials in six (6),85 gallon overpack salvage drums
located at 1210 Park Street is hereby authorized.
Section 3: That pursuant to the provisions of
TEX.L.GOVIT.CODE ANN. S 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND NO 1100
($15,000.00) DOLLARS or less, subject to the provision that the
original contract price may not be increased by more than twenty -
five (25 %) or decreased by more than twenty -five (25 %) percent
without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
