Ordinance No. 6,320Published "in:' THE BAYTOWN SUN 920813 -26 Tuesday, August 18, 1992 Wednesday, August 19, 1992 ORDINANCE NO. 6320 • AN ORDINANCE ESTABLISHING A PRIMA FACIE SPEED LIMIT ON THAT PORTION OF SPUR 330 FROM INTERSTATE 10 TO LOOP 201, DURING CONSTRUCTION; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS FOR EACH VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. WHEREAS, the State Department of Highways and Public Transportation has made it known to the City of Baytown that operations will begin in the near future to make improvements along Spur 330 from Interstate 10 to Loop 201; and WHEREAS, in the interest of safety, it is desirable to maintain a construction speed zone during the construction period; NOW THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a prima facie speed zone of 40 mph be established along Spur 330 from Interstate 10 to Loop 201, during construction, to be effective when so signed within said zone. Section 2: That during construction, necessary signs for posting the speed zones will be furnished, installed, and maintained by the direction of the State Department of Highways and Public Transportation Engineer in charge of the project. Section 3: This ordinance shall be in effect only during the period of construction, and completion of this project shall automatically cancel the speed zones. Section 4: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and No /100 ($1.00) Dollar nor more than Two Hundred and No /100 ($200.00) Dollars except minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than One Hundred and No /100 ($100.00) Dollars. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance. • • s„ 924813 -2ba INTRODUCED, READ and PASSED by the aff irmative vote of the City Council of the City of Baytown, this the 13th day of August, 1992.
