ORDINANCE NO. 6229
• AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON
THE 6TH DAY OF JUNE, 1992, FOR THE PURPOSE OF ELECTING
TWO (2) COUNCILMEN FROM DISTRICTS NOS. THREE (3) AND
SIX (6); PROVIDING FOR THE ELECTION OFFICERS;
DESIGNATING THE PLACES AND MANNER OF HOLDING SAID
ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE
CENTRAL COUNTING STATION; PROVIDING FOR A SPECIAL
CANVASSING BOARD FOR EARLY BALLOTS; AND PROVIDING FOR
THE POSTING AND PUBLICATION OF NOTICE.
WHEREAS, on the 2nd day of May, 1992, the Regular Municipal
Election of the City of Baytown was held for the purposes of
electing a Mayor from the City at large and six Councilmen from
the respective six districts 1, 2, 3, 4, 5, and 6, and the
returns of said election having been duly made by the Election
Officials and the City Council having canvassed said returns and
determined the results of said Election on this 7th day of May,
1992; and
WHEREAS, it is determined from the canvassing of said
returns that no candidate for Councilman from District 3, and
Councilman from District 6 received a majority of the votes cast
at the regular election for the office of which they were
candidates, and accordingly, pursuant to Section 94 of Article IX
of the Charter of the City of Baytown, it is the duty of the City
Council to order a Special Election for the purposes of
submitting to a vote of the qualified voters of said City, the
names of the two eligible candidates receiving the highest number
of votes at the regular election for each of those offices in
order that the voters may designate and elect one of the two
candidates in each office; and
WHEREAS, in ordering such Special Election, it is the duty
of the City Council to determine the eligibility of the
candidates whose names are to appear on the ballot for said
election; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby finds, determines, and declares that as determined by the
canvass of the election returns this flay accomplished by the City
Council, the two eligible candidates receiving the highest number
of votes for the office of Councilman from District No. 3 are Ray
Swofford and Jackson Lawrence.
Section 2: That the City Council of the City of Baytown
hereby finds, determines, and declares that as determined by the
canvass of the election returns this day accomplished by the City
• Council, the two eligible candidates receiving the highest number
of votes for the office of Councilman from District No. 6 are
Stephen DonCarlos and Coleman Godwin.

• Section 3: That a Special Election of the City of Baytown,
as provided in Section 94, Article IX of the Charter of said
City, shall be held between the hours of (7:00) o'clock a.m. and
seven (7:00) o'clock p.m. on the 6th day of June, 1992, in said
City for the purpose of electing a Councilman for District No. 3
and a Councilman for District No. 6 from the candidates listed as

Section 5: That this election shall be held in accordance
with, and shall be governed by, the election laws of the State of
Texas. That the form of said ballot shall be substantially as
follows:

• Section 6: Each qualified voter who desires to cast an early
vote shall be entitled to an official ballot and the right to
cast such ballot in accordance with the provisions of the Texas
Election Code.
Section 7: The City Council Chamber and Conference Room area
in City Hall of the City of Baytown, 2401 Market Street is hereby
established as the Central Counting Station to receive and
tabulate voted ballots. The City Clerk is hereby appointed
Manager of the Central Counting Station and also Tabulation
Supervisor. Ron Embry is hereby appointed Presiding Judge for
the Central Counting Station.
Section 8: There is hereby created an Early Ballot Board
which shall count all early ballots. Sandra Northcutt is hereby
appointed Presiding Judge of the Early Ballot Board.
Section 9: The Mayor is hereby directed to give notice of
said election by publishing a copy of the Election Proclamation
and Notice in a newspaper of general circulation within said
City; said publication to be made in accordance with the Texas
Election Laws.
Section 10: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, Texas, on this the 7th day
of May, 1992.
