ORDINANCE NO. 6228
• AN ORDINANCE AWARDING THE CONTRACT AND AUTHORIZING
CHANGE ORDER NO. 1 FOR COMMUNITY DEVELOPMENT
REHABILITATION PROJECT NO. 91 -06 TO NOLASCO CARPENTRY
FOR THE SUM OF FOURTEEN THOUSAND FIVE HUNDRED TWELVE AND
N01100 ($14,512.00) DOLLARS AND AUTHORIZING PAYMENT
THEREOF.
WHEREAS, the City of Baytown's Community Development Program
did advertise for bids for Community Development Program
Rehabilitation Project No. 91 -06 to be received April 14, 1992;
and
WHEREAS, notice to all bidders as to the time and place,
when and where the contract would be let was published pursuant
to provisions of Section 74 of the Charter of the City of
Baytown; and
WHEREAS, all bids were opened and publicly read at the
Community Development Office at 10:00 a.m., Tuesday, April 14,
1992, as per published notice to bidders; and
WHEREAS, some specifications were unintentionally omitted
from the contract and have now been incorporated into Change
Order No. 1; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of Nolasco Carpentry for the sum of
FOURTEEN THOUSAND FIVE HUNDRED TWELVE AND NO /100 ($14,512.00)
DOLLARS for Community Development Rehabilitation Project No.
91 -06, and Change Order No. 1, being the repair and
rehabilitation of 329 Greenbriar and authorizes payment thereof,
providing that final payment will not be made to said contractor
until completion and acceptance of the work by the owner and the
Baytown Community Development Program.
Section 2: That pursuant to the provisions of
TEX.L.GOVIT.CODE ANN. $ 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original contract
price may not be increased by more than ten (10 %) percent or
decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
• Baytown.
