ORDINANCE NO. 5219
AN ORDINANCE AUTHORIZING THE PAYMENT OF THE SUM OF FIVE
THOUSAND THREE HUNDRED TWENTY -FIVE AND N01100
($5,325.00) DOLLARS TO KINGWOOD SYSTEMS AS THE SOLE
SOURCE FOR MODIFICATIONS TO THE POLICE DEPARTMENT AND
MUNICIPAL COURT COMPUTER SOFTWARE; MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, programming is required for conversion of all
Municipal Court open warrants from the Unisys System to the IBM
RISC6000 system and to merge the system with the Police
Department database; and
WHEREAS, TEX. L. GOV'T. CODE ANN. S 252.022 provides that when
the functional requirements of the City can only be satisfied by
one source, the requirement for competitive bids is not
applicable; and
WHEREAS, the procurement of modifications to the Police
Department and Municipal Court computer software can be satisfied
by only one source, Kingwood Systems, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section is That the City Council of the City of Baytown,
Texas, hereby declares that only one source can satisfy the needs
of the City for modifications to the Police Department and
Municipal Court computer software.
Section 2: That payment to Kingwood Systems, as the sole
source, of FIVE THOUSAND THREE HUNDRED TWENTY -FIVE AND N01100
($5,325.00) DOLLARS, for the above - described modifications to the
Police Department and Municipal Court computer software is hereby
authorized.
Section 3: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. S 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND N01100
($15,000.00) DOLLARS or less, subject to the provision that the
original contract price may not be increased by more than twenty -
five (25 %) or decreased by more than twenty -f ive (25 %) percent
without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
