Ordinance No. 14,144ORDINANCE NO. 14,144 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RENEWING THE ANNUAL MOSQUITO CONTROL CHEMICALS CONTRACT WITH ADAPCO, INC., FOR ITEM NOS. 2, 16, 19, AND 22; CLARKE MOSQUITO CONTROL PRODUCTS, INC., FOR ITEM NOS. 3, 5, 6, 8, 9, 11, 13, 14, 15, 18, AND 21; AND TARGET SPECIALTY PRODUCTS FOR ITEM NOS. 1, 4, 7, 10, 12, 17, AND 20; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FORTY-SEVEN THOUSAND AND NO/100 DOLLARS ($147,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ******************************************************************************** WHEREAS, the Annual Mosquito Control Chemicals Contract was awarded to the following companies for the items noted on June 28, 2018: 1. ADAPCO.Inc. 2 Ready -to -use Pyrethroid with Synergist, 4%-8% 16 Biological mosquito larvicide, Bti liquid, 8% minimum 19 Fyfanon EW insecticide, Malathion 22 VectoBac WDG, biological larvicide, granule 2. Clarke Mosquito Control Products. Inc. 3. Item 3 Description of Awarded Item Ready -to -use Pyrethroid with Synergist, 4° 0-120 o 5 Ready -to -use Chlo ofos/P etliroid mix 6 Ready -to -use Chlorpyrofos, 19% 8 Biological mosquito larvicide briquettes 9 Mosquito larvicide growth regulator briquettes, 30-dayAltosid 11 Mosquito larvicide growth regulator, pellets, 30-dayAltosid WSP 13 Biological mosquito larvicide, granular, S inosad 14 Biological mosquito larvicide, 30-daytablets, S inosad 15 Biological mosquito larvicide, extended release tablets, S inosad 18 Liquid larvicide oil, 10% mineral oil 21 Fourstar Bti CRG, Multi -brood controlled release granule "Target Item 1 SpecialtySpemalty Products Description of Awarded Item Pyrethroid with Synergist, 30%-60% 4 Premixed Pyrethroid with Synergist, 5%-25% 7 Carrying oil for Pyrethroid mix 10 Mosquito larvicide growth regulator, granular, 21 -day Altosid 12 Mosquito larvicide growth regulator, liquid Metho rene SR-5, 5% 17 Liquid larvicide oil, mineral oil 20 Du lex-G, biological mosquito larvicide WHEREAS, such contract may be renewed for an additional one-year term; and WHEREAS, each of the above -referenced companies has indicated its willingness to renew the contract for an additional year under the same terms and conditions; and WHEREAS, the Administration has reviewed the market conditions and recommends renewal as being in the best interest of the City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby renews the Annual Mosquito Control Chemicals Contract with ADAPCO, Inc., for the following items: Section 2: That the City Council of the City of Baytown hereby renews the Annual Mosquito Control Chemicals Contract with Clarke Mosquito Control Products, Inc., for the following items: Item 3 Description of Awarded Item Ready -to -use Pyrethroid with Synergist, 4%-12% 5 Ready -to -use Chlo ofos/P ethroid mix 6 Ready -to -use Chlorpyrofos, 19% 8 Biological mosquito larvicide briquettes 9 Mosquito larvicide growth regulator briquettes, 30-dayAltosid 11 Mosquito larvicide growth regulator, pellets, 30-dayAltosid WSP 13 Biological mosquito larvicide, granular, S inosad 14 Biological mosquito larvicide, 30-daytablets, S inosad 15 Biological mosquito larvicide, extended release tablets, S inosad 18 Liquid larvicide oil, 10% mineral oil 21 Fourstar Bti CRG, Multi -brood controlled release granule Section 3: That the City Council of the City of Baytown hereby renews the Annual Mosquito Control Chemicals Contract with Target Specialty Products for the following items: Item 1 I)escription of Awarded Item Pyrethroid with Synergist, 30%-60% 4 Premixed Pyrethroid with Synergist, 5%-25% 7 Carrying oil for Pyrethroid mix 10 Mosquito larvicide growth regulator, granular, 21 day Altosid 12 Mosquito larvicide growth regulator, liquid Metho rene SR-5, 5% 17 Liquid larvicide oil, mineral oil 20 Du lex-G, biological mosquito larvicide Section 4: That the City Council of the City of Baytown hereby authorizes payment in an amount not to exceed ONE HUNDRED FORTY-SEVEN THOUSAND AND NOI100 DOLLARS ($147,000.00) for Items 1 through 22 of the Annual Mosquito Control Chemicals Contract. Section 5: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND N01100 DOLLARS ($50,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent (250 0) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 6: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
