AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, RENEWING THE ANNUAL MOSQUITO CONTROL CHEMICALS
CONTRACT WITH ADAPCO, INC., FOR ITEM NOS. 2, 16, 19, AND 22;
CLARKE MOSQUITO CONTROL PRODUCTS, INC., FOR ITEM NOS. 3, 5, 6, 8,
9, 11, 13, 14, 15, 18, AND 21; AND TARGET SPECIALTY PRODUCTS FOR
ITEM NOS. 1, 4, 7, 10, 12, 17, AND 20; AUTHORIZING PAYMENT BY THE
CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED ONE HUNDRED
FORTY-SEVEN THOUSAND AND NO/100 DOLLARS ($147,000.00); MAKING
OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, the Annual Mosquito Control Chemicals Contract was awarded to the following
companies for the items noted on June 28, 2018:

WHEREAS, such contract may be renewed for an additional one-year term; and
WHEREAS, each of the above -referenced companies has indicated its willingness to renew the
contract for an additional year under the same terms and conditions; and
WHEREAS, the Administration has reviewed the market conditions and recommends renewal as being
in the best interest of the City; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby renews the Annual
Mosquito Control Chemicals Contract with ADAPCO, Inc., for the following items:
Section 2: That the City Council of the City of Baytown hereby renews the Annual
Mosquito Control Chemicals Contract with Clarke Mosquito Control Products, Inc., for the
following items:

Section 3: That the City Council of the City of Baytown hereby renews the Annual
Mosquito Control Chemicals Contract with Target Specialty Products for the following items:

Section 4: That the City Council of the City of Baytown hereby authorizes payment in an
amount not to exceed ONE HUNDRED FORTY-SEVEN THOUSAND AND NOI100 DOLLARS
($147,000.00) for Items 1 through 22 of the Annual Mosquito Control Chemicals Contract.
Section 5: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order
involving a decrease or an increase in costs of FIFTY THOUSAND AND N01100 DOLLARS
($50,000.00) or less, subject to the provision that the original contract price may not be increased by
more than twenty-five percent (250 0) or decreased by more than twenty-five percent (25%) without
the consent of the contractor to such decrease.
Section 6: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
