ORDINANCE NO. 6215
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FIVE
THOUSAND TWO HUNDRED NINETY AND N01100 ($5,290.00)
DOLLARS TO CHLORINATOR MAINTENANCE COMPANY FOR THE
REPLACEMENT OF THE CHLORINATOR ; MAKING OTHER PROVISIONS
RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, the chlorinator at the West District Wastewater
Treatment Plant has failed; and
WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in
case of procurements for the protection of public health or
safety, the requirement for competitive bids is not applicable;
and
WHEREAS, informal bids for the replacement of the
chlorinator have been obtained, and Chlorinator Maintenance
Company, is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Chlorinator Maintenance Company
of the sum of FIVE THOUSAND TWO HUNDRED NINETY AND N01100
($5,290.00) DOLLARS for the replacement of the chlorinator is
hereby authorized.
Section 3: That pursuant to the provisions of
TEX.L.GOVIT.CODE ANN. § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTEEN THOUSAND AND NO 1100
($15,000.00) DOLLARS or less, subject to the provision that the
original contract price may not be increased by more than twenty -
five (25 %) or decreased by more than twenty -five (25 %) percent
without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 9th day of April,
