AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, GRANTING A VARIANCE TO THE MAXIMUM ASSISTANCE
LIMITS FOR THE OWNER -OCCUPIED HOUSING REHABILITATION
PROGRAM; AWARDING THE CONTRACT FOR THE HOUSING
RECONSTRUCTION PROJECTS LOCATED AT 720 BOLSTER STREET
AND 412 STEWART STREET TO R&R COMMERCIAL & RESIDENTIAL
CONSTRUCTION, LLC, FOR THE SUM OF TWO HUNDRED TWENTY-
ONE THOUSAND EIGHT HUNDRED AND NO100 DOLLARS
($221,800.00); AUTHORIZING PAYMENT THEREOF; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown's Community Development Program did advertise for
bids for housing reconstruction projects located at 720 Bolster Street and 412 Stewart Street to be
received July 19, 2019; and
WHEREAS, notice to all bidders as to the time and place, when and where the contract
would be let was published pursuant to provisions of Section 74 of the Charter of the City of
Baytown; and
WHEREAS, all bids were opened and publicly read at City Hall at 10:10 a.m., Friday,
July 19, 2019, as per published notice to bidders; and
WHEREAS, the amounts bid for the projects exceed the maximum assistance limits for
the Owner -Occupied Housing Rehabilitation Program, which is SIXTY-FOUR THOUSAND
AND NO/100 DOLLARS ($64,600.00) and based upon a 2010 standard; and
WHEREAS, the bids received, however, were competitive with the 2019 construction
market at approximately NINETY AND NO/100 DOLLARS per square foot ($90.00/SF2) and
with the average cost for home construction in the Revitalization Zone between 2017 and 2019,
which is ONE HUNDRED SEVEN THOUSAND EIGHT HUNDRED NINETY-THREE AND
NO/100 DOLLARS ($107,893.00); and
WHEREAS, the City Council desires to grant a variance to the maximum assistance
limits for the Owner -Occupied Housing Rehabilitation Program and to accept the bids received;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown hereby grants a variance to
the maximum assistance limits for the Owner -Occupied Housing Rehabilitation Program in order
to increase such maximum limit from SIXTY-FOUR THOUSAND AND NO'100 DOLLARS
($64,600.00) to NINETY-TWO THOUSAND TWO HUNDRED AND NO/ 100 DOLLARS
($92,200.00).
Section 2: That the City Council of the City of Baytown hereby accepts the bid of
R&R Commercial and Residential Construction, LLC, for the sum of TWO HUNDRED
TWENTY-ONE THOUSAND EIGHT HUNDRED AND NOI100 DOLLARS ($221,800.00) for
the following projects and authorizes payment thereof upon final completion and acceptance of
the work by the owner and the Baytown Community Development Program:
Section 3: That pursuant to the provisions of Texas Local Government Code
Annotated ยง252.048, the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of FIFTY THOUSAND AND NOI100
DOLLARS ($50,000.00) or less, subject to the provision that the original contract price may not
be increased by more than twenty-five percent (25%) or decreased by more than twenty-five
percent (25%) without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
