Ordinance No. 6,212920409 -4 ORDINANCE NO. 6212 • AN ORDINANCE RENEWING THE CONTRACT OF HAZELWOOD ENTERPRISES, INC. FOR THE SANITARY LANDFILL CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF THREE HUNDRED SIXTY -FOUR THOUSAND SEVEN HUNDRED EIGHT AND 40/100 ($364,708.40) DOLLARS; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Hazelwood Enterprises, Inc. was awarded the solid waste collection and disposal contract, pursuant to competitive bidding procedures, on April 1, 1986, and said contract was amended on April 14, 1988, and again on December 15, 1989, which contract included an option by the parties to renew for nine additional one (1) year periods; and WHEREAS, Hazelwood Enterprises, Inc. has indicated their willingness to renew the contract for an additional year with an increase of $0.11 per cubic yard of loose solid waste, an increase of $0.11 per cubic yard of compacted solid waste, and an increase of $0.30 per cubic yard of sewer sludge; and WHEREAS, the Administration has reviewed the market conditions and recommends renewal as being in the best interest of the City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby renews the contract of Hazelwood Enterprises, Inc. for the sanitary landfill contract for the sum of THREE HUNDRED SIXTY - FOUR THOUSAND SEVEN HUNDRED EIGHT AND 40/100 ($364,708.40) DOLLARS, and authorizes payment thereof. Section 2: That pursuant to the provisions of TEX. L.GOV'T.CODE ANN 5 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTEEN THOUSAND AND N01100 ($15,000.00) DOLLARS or less, subject to the provision that the original contract price may not be increased by more than twenty - five (25 %) or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
