ORDINANCE NO. 6175
AW ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS AMENDING CHAPTER 12, "FIRE PREVENTION AND
PROTECTION ", ARTICLE III "FIRE MARSHAL ", OF THE CODE OF
ORDINANCES BY AMENDING SECTION 12 -31 "OFFICE CREATED ",
SECTION 12 -32 "SUPERVISION ", AND SECTION 12 -33 "DUTY TO
INVESTIGATE FIRES "; PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 12, "Fire Prevention and
Protection ", Article III "Fire Marshal", Section 12 -31 "Office
Created ", of the Code of Ordinances, City of Baytown, Texas, is
hereby amended to read as follows:
Sec. 12 -31. Office created.
An arson investigation unit is hereby created.
Section 2: That Chapter 12, "Fire Prevention and
Protection ", Article III "Fire Marshal", Section 12 -32
"Supervision ", of the Code of Ordinances, City of Baytown, Texas,
is hereby amended to read as follows:
Sec. 12 -32. Supervision.
The duties of the Fire Marshal shall be performed
as assigned by the Fire Chief. When available, this
duty shall be assigned to an Assistant Fire Chief who
shall supervise the arson investigation unit.
Section 3: That Chapter 12, "Fire Prevention and
Protection ", Article III "Fire Marshal ", Section 12 -33 "Duty to
Investigate Fires ", of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to read as follows:
Sec. 12 -33. Duty to investigate fires.
The arson investigation unit shall investigate
the cause, origin and circumstances of every fire
occurring within the City by which property has been
destroyed or damaged, and shall especially make
investigation as to whether such fire was the result
of carelessness or design.
Section 4: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided however, that such repeal shall be only to the

extent of such inconsistency and in
ordinance shall be cumulative of other
governing the subject matter covered by

ordinances regulating and
this ordinance.
Section 5: If any provisions, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 27th day of
February, 1992.
