Ordinance No. 6,150920213 -4 ORDINANCE NO. 6150 • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RECLASSIFYING CERTAIN POSITIONS IN THE FIRE DEPARTMENT OF THE CITY OF BAYTOWN; PROVIDING FOR THE REALLOCATION OF POSITIONS WITHIN CERTAIN CLASSIFICATIONS; PROVIDING FOR THE STATUS OF PRESENT EMPLOYEES; AMENDING THE BUDGET ORDINANCE OF THE CITY OF BAYTOWN FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1991 AND ENDING SEPTEMBER 30, 1992, TO REFLECT SUCH RECLASSIFICATION AND REALLOCATION OF POSITIONS; PROVIDING FOR A SAVINGS CLAUSE; REPEALING ALL CONFLICTING ORDINANCES; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the Chief of the City of Baytown Fire Department has recommended to City Council that certain positions in the Fire Department be reclassified, certain positions be renamed and the number of certain positions within such classifications be reallocated; and WHEREAS, the Chief of the City of Baytown Fire Department has made these recommendations based upon his personal study of such classifications, the future needs of the Fire Department and his experience within such department; and WHEREAS, these recommended changes would assist the orderly, efficient operation of the Fire Department and assist in attaining the goals of economy, and efficiency through strengthening the chain of command, balancing command responsibility, and providing the Fire Department with a broader command staff; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown finds that the goals of efficiency and economy would best be served by reclassifying the "Fire Marshall" to the rank and title of "Assistant Fire Chief ", who shall also be known as the "Fire Marshall ", by renaming "Fire Captain" to "Fire Battalion Chief" and reducing the number by one (1) position, adding three (3) Lieutenants positions and reducing the number of Fire Equipment Operators by six (6). Section 2: That such additions and reductions shall be effective upon the effective date of this ordinance, however, no present member of the classified service shall suffer any decrease in salary or loss of position and that such reclassification and reallocation should be achieved through promotion or attrition within the budget year. • 920214 -4a • Section 3: That the budget of the City fiscal year October 1, 1991 to September 30, of Baytown for the 1992, as adopted by Ordinance No. 6002 is hereby amended to read as follows: FIRE 2020 -71 -1 Fire Chief 1 3088 -4972 Assistant Fire Chief 2 2664 -4182 Fire Battalion Chief 4 2358 -3494 Total 7 2020 -71 -2 Lieutenant 19 2184 -3210 Fire Equipment Operator 15 2025 -2951 Firefighter 30 1879 -2614 Mechanic 1 1621 -2306 Fire Secretary 1 1744 -2502 Fire Dispatcher 5 1509 -2127 --------------- Total 71 C Section 4: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 6: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
