Ordinance No. 6,112911212 -24 ORDINANCE NO. 6112 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH MCI FOR LONG DISTANCE PHONE SERVICES; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN OF THE SUM OF NINE THOUSAND AND NO 1100 ($9,000.00) DOLLARS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the Mayor and City Clerk of the City of Baytown to execute and attest to an agreement with MCI for long distance phone services. A copy of said agreement is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: That the City Council of the City of Baytown authorizes payment of the sum of NINE THOUSAND AND N01100 ($9,000.00) DOLLARS, pursuant to the Agreement. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. General The State Purchasing and General Services Commission (SPGSC) is responsible for planning, establishing, and managing the operation of a system of telecommunications services for all state agencies. The Texas Agency Network (TEX -AN) is, and will continue to be, used to the maximum extent possible to meet the long distance needs of the various state agency locations. Each agency location, whether on TEX -AN or not, must have access to a long dis- tance carrier. Those locations on TEX -AN use the services of the long distance carrier for overflow traffic or for providing service when TEX -AN is not available. Those locations not on TEX -AN use the long distance carrier for their primary service. This Invitation for Bid (IFB) is to obtain a cost effective service to supplement the existing TEX -AN network and to meet the statewide long distance requirements for carrier provided services as described above. As a result of this IFB, the SPGSC will offer agency locations three options for alternative long distance service: 1) remain with the current provider until the present contract and all extension options have expired; 2) obtain the services of a regulated carrier as permitted under the provisions of Section 3.01 (b)(4), Article 601b, V.T.C.S, as an approved delegated purchase by the SPGSC; or 3) use the services obtained via this IFB as managed under SPGSC procedures. (NOTE: THE ABOVE PARAGRAPH WAS DELETED IN ITS ENTIRETY BY ADDENDUM DATED 3- 22 -91.) No guarantees can or will be made on the amount of usage which will be offered to a carrier under this IFB. The State also reserves the right to procure the identified services or similar services from any regulated vendor at either regular tariff or customer specific tariff rates. (NOTE: THE SECOND SENTENCE IN ABOVE PARAGRAPH WAS DELETED BY ADDENDUM DATED 3- 22 -91.) MCI understands and will comply. The Telecommunications Services Division, SPGSC, does not intend to convert TEX -AN provided long distance to an alternative carrier provided service nor is it the intent of the services under this IFB to supplant TEX -AN services. -1- r � F The determination will be made solely by the Telecommunications Services Division and will be based on factors such as the actual cost of providing TEX -AN service to a location, originating and terminating traffic patterns, and the perceived benefits to the State of maintaining a private network which maximizes participation within an acceptable range of costs. Vendors are invited to submit bids in accordance with the requirements of this document for virtual network long distance service. Minimum specifications and requirements for this service are listed in this Invitation For Bids (IFB). Offers expiring in less than sixty (60) days following the opening of bids will not be considered. Vendors are expected to examine the entire Invitation For Bids. Vendor responses must address each item in the IFB in the order presented and affirmatively state their compliance or non - compliance with state requirements. Vendors offering responses to this Invitation For Bids (IFB) must provide address and telephone number of sales and customer support staff. MCI understands and will comply. 1.1 Locations of Potential Contract Users A. Any contract resulting from this IFB will be designated as a Texas Statewide Contract. Any State Agency, county, municipality, special district, school district, junior college district, or other legally constituted political sub - division of the State may -2- order these services directly from a resulting statewide contract without re- initiating a competitive acquisition. Services needed will be ordered using a Contract Purchase Order rendered against the contract. B. Local Governmental Participation in State Contracts: V.T.C.A., Local Government Code Section 271.081 et seq., established a program by which eligible local governments may purchase items through the State Purchasing and General Services Commission (SPGSC). Some local governments have indicated their desire to participate in this cooperative purchasing effort, may be eligible to do so, and will purchase all of their requirements (except emergency needs) under the contract resulting from this Invitation for Bids. 1.1 MCI understands and will comply. 1.2 Glossary of Terms 1.2.1 IFB (Invitation For Bids) 1.2.2 FCC (Federal Communications Commission) 1.2.3 PUC (Texas Public Utility Commission) 1.2.4 Dialers (an interface device used with IA key, electronic key and PBX telephone systems to dial a carrier's access code when placing 1+ calls). 1.2.5 LSO (Local Serving Office) 1.2.6 SPGSC (State Purchasing and General Services Commission) 1.2.7 virtual network (Combination of switched and private line facilities to derive network functions that traditionally have been provided by private lines. Allows a subscriber to establish a private network as an overlay on the switched carrier network.) 1.2 MCI understands and will comply. 1.3 Purpose The State of Texas will acquire, as a result of this Invitation For Bids (IFB), virtual network long distance service to support the needs of state government. The ac service must satisfy the requirement for both intrastate and interstate long distance calling. A virtual network arrangement is required in response to this IFB. It is the State's desire to satisfy the users' needs and requirements with minimum disruptions. The intent of this IFB is to select a vendor who will offer service with high quality at a low cost. Vendor will be required to quote guaranteed rates for intrastate and interstate calling. The State, based on an evaluation of the bids, will award one contract for the requested services. The contract will be awarded to a vendor to provide virtual network long distance service from equal access local serving offices. 1.3 MCI understands and will comply. 1.4 Scope of services 1.4.1 The virtual network long distance service provided shall meet all the performance standards defined. 1.4.2 The vendor shall provide billing and trouble resolution service. 1.4 MCI understands and will comply. 1.5 objective of this IFB It is the purpose of this IFB to cause the furnishing of virtual network long distance service that meets the following objectives: 1.5.1 The service provided shall adhere to the highest standards of functionality and reliability established in these specifications. 1.5.1 MCI understands and will comply. 1.5.2 Availability - All connections must function properly and meet or exceed 99.9% availability. 1.5.2 MCI understands and will comply. -4- 1.5.3 Restorability - Mean time to restore service must equal or exceed the requirements stated. (See Section 7.12) 1.5.3 MCI understands and will comply. 2. Administrative information 2.1 Issuing Office This IFB is issued for the State of Texas by the State Purchasing and General Services Commission. The issuing office is the sole point of contact between vendors and the State for the selection process. 2.1 MCI understands and will comply. 2.2 Point of Contact The official point of contact concerning this IFB is Mr. Oscar Gonzalez, Purchaser (telephone 512- 463 - 3380). 2.2 MCI understands and rill comply. 2.3 Inquiries It is the responsibility of the vendors to inquire about and clarify any requirement.of this IFB that the vendors do not understand. The State of Texas will not be bound by oral responses to questions. No inquiries will be accepted less than ten (10) days prior to bid opening. 2.3 MCI understands and will comply. -5- 2.4 2.4 2.5 2.5 3. 3.1 3.1 Cost of Bid Responses Vendors electing to respond to this IFB are responsible for all-costs of bid preparation. The State is not liable for any costs incurred by a vendor in response to this IFB, MCI understands and will comply. Vendor Qualifications and FCC /PUC Requirauents The vendor, by submitting a bid for the requested service, hereby certifies that it owns all federal and state licenses and registrations required of a common carrier and that it is currently complying with all required FCC /PUC rules and regulations for interstate and intrastate telecommunications services. Any failure on the part of the vendor to maintain such licenses and registrations and to continue compliance with FCC /PVC rules and regulations shall be grounds for termination of any contract which is awarded as a result of this Invitation For Bids. MCI understands and will comply. Management and operations Billing Cycle The billing cycle shall begin on the first day of each month and end on the last day of each month. All bills shall be issued by the vendor within 20 calendar days from the end of a billing cycle. The vendor shall bill for all charges incurred in the previous month. Delayed charges shall be billed in the next cycle at rates and volume discounts applicable to the previous billing cycle. The vendor must have the capability to bill each location directly or to aggregate billing for multiple locations if requested. MCI understands and will comply. -6- 3.2 Billing Retention The vendor shall be able to provide the state with detailed billing information for the past 12 months within 10 business days following such request. 3.2 KCI understands and will comply. 3.3 Usage Reports On a quarterly basis State Purchasing and General Services Commission, Telecommunications Services Division, must receive usage reports for each location. These reports must show total minutes and costs, by the various rate periods, associated with intrastate and interstate usage. A grand total for each location must also be provided. 3.3 MCI understands and will comply. 4. Contract Terms and Conditions 4.1 Length of contract period will be two years. No increase in rates for this period will be allowed. 4.2 The State reserves the right to procure the identified services or similar services from any regulated vendor at either regular tariff or customer specific tariff rates. (NOTE: THE ABOVE SECTION WAS DELETED IN ITS ENTIRETY BY ADDENDUM DATED 3- 22 -91.) 4.3 The State Purchasing and General Services Commission reserves the right to cancel any resulting contract with thirty (30) days written notice if the vendor fails to meet the price or performance specifications as bid. The State shall not be liable to any successful vendor for any back charges in the event that any regulatory body rules that rates bid by the successful vendor should be higher. The successful vendor shall indemnify and hold the State harmless from any such back charges. 4. MCI understands and will comply. -7- 5. ]Agency Terms and Conditions 5.1 Billing Billing must be based on usage to a tenth of a minute. Any usage above a tenth of a minute may be rounded up to the next highest tenth. The State Purchasing and General Services Commission acknowledges that intraLATA long distance calls are generally billed by the Local Exchange Company, e.g. Southwestern Bell, GTE, United, Continental, etc. Bid responses which provide reduced rates for intralata long distance by transporting such calls over the vendor's facilities will be evaluated using vendor provided rates rather than tariffed Southwestern Bell rates. If vendors are offering to provide intraLATA service, a separate rate schedule in the format of Attachment B, must be provided with the bid response and a description given on how the service is to be accessed. 5.1 MCI Description for intraLATA service access: When a caller wishes to use MCI for intraLKTA long distance service, the caller /PBX must first dial /enter 10222 followed by 1 and then area code and number. By dialing 10222, this insures that the serving local exchange company will 11svitch'e the call to the MCI network for completion. 5.1 MCI understands and will comply. 5.2 Usage Levels The State will not guarantee a fixed amount of usage nor will it guarantee the number of locations which may subscribe to the virtual network long distance services. 5.2 MCI understands and will comply. 5.3 Terminations Notice Any location that elects to obtain virtual network long distance services under the terms of a resulting contract may terminate them at any time during the contract period upon giving the vendor seven days notice. 5.3 MCI understands and will comply. -8- 6. Long Distance Telephone Service specifications 6.1 Type of Service The vendor must provide intrastate and interstate long distance telecommunications services, including Hawaii, Alaska, Puerto Rico, and the U.S. Virgin Islands. 9 6.1 MCI understands and will comply. 6.2 Service Points There are potentially 1500 locations with approximately 100 -200 minutes of average monthly usage each. Neither usages levels nor number of locations will be guaranteed. (See section 5.2) 6.2 MCI understands and will comply. 6.2.1 The State currently has a private network, this network uses a seven (7) and a ten (10) digit dialing plan. The seven (7) digit dialing plan is used for completing on -net calls only. The ten (10) digit dialing plan is used for completing calls off -net or calls to locations on -net that are equipped with a PBX. The virtual network services provided by the vendor must interface with this dialing plan. Vendors must describe how their proposed services can interface to the TEX -AN dialing plan. This interface may be through a T -1 connection to either a #5 ESS Switch (if AT &T provided service) or an InteCom S80+ IBX (if non -AT &T provided), both located in the Sam Houston Building, 201 East 14th Street, Austin, Texas. The T -1 access, if proposed by the vendor, will only be used for terminating traffic onto the TEX -AN network. 6.2.1 MCI Vnet service will interface with the TEX -AN dialing plan as follows: After the State of Texas selects MCI as the long distance carrier of its business lines, Vnet Dial one service is chosen as the access method rather than MCI's regular Dial one service. -9- T -1 access will be from MCI to the InteCom 8 -80+ IBX and will only be used for terminating traffic. The dialing plan for 10 -digit calls is the normal dialing plan for'that call area. To dial a 7 -digit T8X -AK on- network number, a caller simply dials "1- 700* before the number. MCI recognizes the "700" and treats the 7 -digit call as dictated in the State of Texas) 7 -digit on -vnet numbering plan. 6.2.1 MCI understands and will comply. 7. Mandatory Requirements The following requirements, terms and conditions are mandatory. Vendors taking exception to the requirements, terms and conditions listed in this section will be deemed to be non - responsive to the IFB and their bids will receive no further consideration. -10- 7.1 The vendor must provide account codes if requested. 7.1 MCI understands and rill comply. 7.2 The vendor must provide applicable rate schedules as described in Section 8.3. 7.2 MCI understands and rill comply. 7.3 The vendor must provide a list of equal access LSO's from which service is available under a contract awarded by this IFS. Equal access ISO's must be provided in the format described in section 8.4. 7.3 MCI understands and rill comply. 7.4 vendor must meet the vendor qualifications and FCC /PUC requirements listed in Section 2.5. 7.4 MCI understands and will comply. 7.5 The vendor must provide virtual network long distance services 24 hours a day, 7 days a week. 7.5 MCI understands and rill comply. 7.6 Billing Detail Unless aggregate billing for multiple locations is requested, the vendor must provide monthly bills directly to each location. If aggregate billing is requested, it shall be provided to the designated locations. All monthly bills must be arranged by originating telephone number to show the following: date of call, time of call, called telephone number and city location, length of call (to a tenth of a minute), and charge for each call. The vendor must provide an example of a monthly bill for a single location, and of aggregate billing for multiple locations. The vendor shall provide billing information, including call detail, on magnetic tape if requested by the State. -11- Billing errors must be handled within five (5) business days. Any adjustment in favor of the State must be reflected on the next bill. 7.6 MCI has attached examples of billing information and reports (including call detail) for a single location and of aggregate billing information and reports (including call detail) for multiple locations. 7.6 MCI understands and will comply. 7.7 Vendor must provide virtual network service from each location. Dialers are not permitted. 7.7 MCI understands and will comply. 7.8 Full answer supervision for all calls is required. Vendor must explain its method of handling potential charges for unanswered calls at the distant location. Billing for calls will not begin until answer supervision is received from the called party. 7.8 MCI method for handling potential charges for unanswered calls at the distant location provides for the calling /billed party to contact the MCI operator and to explain the situation. Credit will be reported on next following billing for calls allowed. If a situation persists, MCI will work with the calling party and the affected local exchange companies to isolate the cause and help resolve the situation. 7.8 MCI understands and will comply. 7.9 Vendor must meet or exceed P.01 access grade of service. 7.9 MCI understands and will comply. 7.10 Transmission quality must meet a 0 to -4db, and should not exceed a +2db. 7.10 MCI understands and will comply. -12- 7.11 customer Service office vendor must maintain a customer service office staffed with two or more persons to handle service needs, problems, billing errors, questions, etc. This office shall conduct normal business from 8:00 a.m. to 5:00 p.m., Monday through Friday, with the exception of State and Federal holidays. 7.11 MCI understands and will comply. The vendor shall provide a toll -free telephone number for the State's use when contacting sales or customer service. 7.11 MCI understands and rill comply. 7.12 service responsibilities: Service outages shall be restored within 8 working hours. 7.12 MCI understands and gill comply. 8. Cost Response 8.1 No location charges will be permitted for virtual network service. 8.1 MCI understands and rill comply. 8.2 The only monthly recurring charge permitted for virtual network service will be the T -1 access from the vendor's facility to either the #5 ESS Switch or the InteCom S80+ IBX described in Section 6.2.1., if T -1 access is used to provide the interface to the TEX -AN dialing plan. No other monthly recurring charges are permitted. vendor must state the monthly cost of this access and any applicable one -time installation charges. For costing purposes, assume one T -1 circuit from the vendor's facility to either of the above two switches. 8.2 cost: Monthly charge for one T -1 circuit is $450.40. one -time installation charge for T -1 circuit $ -0 -. 8.2 MCI understands and rill comply. -13- 8.3 The vendor must state the usage rates by mileage band for intrastate and interstate. The vendor must provide one (1) rate schedule for intrastate interLATA and one (1) for interstate calls (Attachments A and 0) unless proposing to carry intraLATA calls over their facilities and at their rates. If the vendor is proposing to carry intraLATA calls, the rate schedule contained in Attachment a must be submitted. If the vendor's proposal to interface with the TEX -AN dialing plan results in different rates than those contained in Attachment A, an additional intrastate rate schedule (Attachment C) for switched access locations to call on -net TEX -AN locations must be submitted. 8.3 MCI understands and will comply. 8.4 The vendor must list equal access LSO's from which service is available. To be eligible for contract award, vendor rates quoted in response to Section 8.3 must be available from a minimum of 80% of equal access serving offices in Texas. Equal Access ISO's are to be identified by NPA /NXX. The vendor must use the attached Private Line Service Tariff, and use the first NPA -NXX only when listing equal access ISO's on Attachment I. Should a vendor bid multiple equal access ISO's within a city, equal access LSO's must be listed separately. (See Attachments J and K for examples). 8.4 MCI understands and will comply. 8.5 Volume discounts, if offered, must be included with bid. They will not be used in the basic evaluation since the State is unaware of specific usage levels by location. 8.5 MCI understands and Will comply. 8.5 No installation charges /disconnect charges are permitted for virtual network service. The selected vendor must pay all charges or fees for converting the customer to the new virtual network service. 8.6 MCI understands and Vill comply. -14- 8.7 Prig Adjustuents Vendors will not be permitted to increase rates during the term of the contract. 8.7 XCI understands and will comply. 9. Bid Evaluation A contract will be awarded to the vendor submitting the lowest and best bid for intrastate and interstate service conforming to the specifications required. To determine who has the lowest and best bid, the State will evaluate cost and the number of serving offices from which service is offered at the rates quoted. Cost will constitute ninety (90) percent of the evaluation score, and the number of serving offices will constitute ten (10) percent. To receive an award, a vendor must also meet the other mandatory requirements of the bid specifications. No increase in rates will be allowed after a bid is opened. A vendor may reduce its rates only after being awarded a contract. A bid which materially fails to comply with these specifications and /or does not include completed Attachments A and D will be rejected. MCI understands and will comply. 9.1 Non -Cost Related Item Point Section Requirement Value 8.4 Number of LSO's From Which Service is being Offered 50 The vendor serving the most equal access serving offices will receive the maximum of 50 points. The points awarded other vendors will be proportionately reduced. For example, if a vendor proposes to serve ten percent fewer serving offices, that vendor will receive 45 points (50 minus ten percent of 50). 9.1 MCI understands and will comply. -15- 9.2 cost svaluation Relative vendor costs for intrastate and interstate calling will be determined in the following manner: A. The calls listed in Attachments E, F, G, and H will be priced out using the rates each vendor provided in Attachments A, B, C, and D respectively. Vendors are to price out the calls in Attachments E, F, G, and H as part of their bid response. Evaluators will conduct their own independent pricing using vendor provided rates. Evaluator pricing will be the basis of bid award. The evaluators, however, will be able to compare the results of their pricing with that provided by the vendors to insure no misunderstanding of the vendor's rates. If a vendor did not propose to carry intraLATA traffic over their own facilities and at their own rates, the calls in Attachment F will be priced out at Southwestern Bell intraLATA long distance rates. If a vendor did not propose a system which would provide different rates for interfacing with the TEX -AN dialing plan and, therefore, did not submit a separate rate schedule for switched access to on -net TEX -AN locations (Attachment C), the calls in Attachment G will be priced out at the rates that the vendor submitted in Attachment A. B. In addition, the vendor was permitted to bid a monthly recurring charge and a one -time installation charge for a T -1 access circuit from the vendor's facilities to the State premises in the Sam Houston Building (Section 8.2), if the vendor proposed T -1 access in order to interface to the TEX -AN dialing plan. The monthly recurring charge, if bid, will be divided by 150,000 minutes (the number of monthly minutes that 24 circuits can carry at a P.01 grade -of- service) to determine an average monthly cost per minute for access. The one -time installation charge will be divided by 900,000 minutes to determine an average cost per minute to recoup non - recurring charges during the first six months of the contract. The average cost per minute for access and the average cost per minute to recover non - recurring costs will then be added and the resulting rate will be applied to the sample calls in Attachment G to determine the amount that costs derived in Step A above needs to be incremented to account for the access charges for the T -1. C. For example, multiplying these factors by the sample call minutes in Attachments E, F, G, and H will show that approximately 91% on the network traffic is intrastate; 11% is evening, night, or weekends; and 24% of the intrastate traffic is destined for on -net TEX -AN locations. These factors were carefully chosen to assure that the cost evaluation was based on the average distribution of anticipated traffic. Actual traffic patterns may change, but should be somewhat close to that described in this section. D. The vendor having the lowest total cost resulting from Steps A through C above will be awarded 450 points. Other vendors scores will be proportionately reduced by the percentage that their costs exceeded the lowest bid. For example, if a vendor's calculated cost in Step C was 10% higher than the lowest bid, that vendor would be awarded 405 points (450 points minus 10% of 450 points). 9.2 mCI understands and will comply. -17- 9. 3 Scores from Sections 9.1 and 9.2 will be totaled and the vendor having the highest aggregate score will be selected as having the lowest and beat bid and will be eligible for a contract award. 9.3 MCI understands and will comply. In the late 1960's, MCI virtually invented competition in the telecommunications industry by becoming the first company authorized by the FCC to compete with AT &T in the domestic long distance market. MCI NETWORK MCI owns and operates the world's most modern telecommunication network to carry voice,data and messaging transmissions around the world. The MCI Public Switched Network is a showcase of the latest in digital technology. Our state -of- the -art fiber optic and digital transmission systems, advanced software -driven switches, and digital cross connects provide unsurpassed network capacity, flexibility, and control. Over 80% of the MCI network has been developed in the last four years and represents an investment of $7.4 billion. An additional $4 billion in additional enhancements is planned for 1991 -1992. The MCI digital network today is more that double its 1987 size, with more than 30,000 digital route miles. All new construction is 100% digital. In August 1990 MCI announced plans to complete full digitization of the network by the end of 1991. The timetable represents a two year acceleration of network digitalization. The plans to transform the network include the integration of 3,000 miles of optical fiber acquired through the merger with Telecom USA; a projected $1.1 billion network investment in 1991; and a capacity exchange agreement with Williams Telecommunications Group (WilTel) which will provide MCI with additional digital capacity and redundancy. Technological leadership in the development of MCI's network has enabled the company to achieve an impressive list of "firsts" in the telecommunications industry. MCI NETWORK FIRSTS MCI - First To ... ♦ develop and commercially operate single mode fiber optic systems, capable of transmitting voice, data, or video information at 405 million bits per second (1983); ♦ complete the nation's longest high - capacity single -mode fiber optic route (from Downers Grove, Illinois to Perryman, Maryland in 1985); ♦ introduced an 810 - megabit fiber optic link for commercial communications traffic (1986); ♦ install a 1.13 gigabit fiber optic link (1987); ♦ introduce a 1.8 gigabit per second transmission, the fastest transmission rate in commercial use (1988); ♦ introduce the first dedicated FAX network, MCI FAX (1988). The MCI network is a totally redundant digital network which combines fiber optics, digital radio, and the latest in digital cross - connect technologies. The network backbone making up the first route choice for any call consists of only fiber optics and digital radio facilities. Analog facilities are used only to carry calls during network congestion or outages rather than block the call. As of September 1990, MCI operated 91 switched in its network. By year -end 1990, 97% of the port configurations on these switches will be digital. MCI utilizes switches manufactured by Digital Switch Corporation, Northern Telecom, Rockwell International, and Ericcson. By not relying on one vendor to drive MCI's network intelligence, we are able to gain feature /functionality availability and timely project response. Before new technologies are integrated into the MCI network, they are exhaustively tested at the MCI Engineering Development Laboratory in Reston, Virginia, to make sure all hardware and software perform in harmony before being placed in service. MCI continually reinvests in the network deploying leading edge technology. As a result of MCI's third quarter in 1990 write -down of analog equipment, the network will be 100% digital by year end 1991. New digital radio with Forward Error Correcting capabilities is also being deployed which has performance specs better than fiber. In addition, new digital cross connect equipment is being installed to improve restoration, installation, provisioning, and monitoring of the network. New Extended Superframe (ESF) equipment that interfaces with the CSU's will allow data users to see performance specs from end to end, not just the MCI link.
