AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING PAYMENT UP TO THE SUM OF THREE
THOUSAND AND N01100 ($3,000.00) DOLLARS TO GIFFORD -HILL,
INC. FOR WELDING SERVICES ON THE SANITARY SEWER FORCE
MAIN AT THE WOODLAWN LIFT STATION; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, a 16" sanitary sewer force main that serves the
Woodlawn lift station has failed in the area of the drainage
ditch located at the intersection of Kilgore Road and James
Street; and
WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in
case of procurements for the protection of public health or
safety, the requirement for competitive bids is not applicable;
and
WHEREAS, informal bids for welding services on the sanitary
sewer force main at the Woodlawn lift station have been obtained,
and Gifford -Hill, Inc., is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Gifford -Hill, Inc. up to of the
sum of THREE THOUSAND AND N01100 ($3,000.00) DOLLARS for welding
services on the sanitary sewer force main at the Woodlawn lift
station is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 12th day of
December, 1991.
