ORDINANCE NO. 6046
AN ORDINANCE PROVIDING FOR THE REDISTRICTING OF THE
CITY OF BAYTOWN AS PROVIDED BY ARTICLE NO. II,
SECTIONS 12 AND 17 AND THE ORDER OF THE COURT IN
CAMPOS ET AL VS. CITY OF BAYTOWN ET AL; PROVIDING
FOR TERMS OF OFFICE; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, Article II, Sections 12 and 17 of the Charter of
the City of Baytown provide that the City shall be divided into
Districts according to the latest population figures; and
WHEREAS, the Order of the Court in Campos, et al vs. City of
Baytown, et al, provides for the creation of a voting district
plan that shall include a single member district in which
minority voters shall be the majority; and
WHEREAS, it is deemed advisable at this time, that the City
of Baytown be redistricted so as to reflect the new population
figures for the City as determined by the Federal Census of 1990;
NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City of Baytown is hereby divided into
Six (6) Election Districts as follows:
SEE ATTACHED EXHIBIT "A ".
Section 2: The City Council shall be composed of a mayor
and six councilmembers who shall be elected in the following
manner: the mayor shall be elected from the City at large for a
term of two years. The City shall be divided into six districts
as described in Section 1 above, and one councilmember, who is a
bona fide resident thereof, shall be elected from each district
by majority vote of the resident citizens of that district. Of
the six councilmembers to be elected at the first election under
this plan, the three councilmembers -elect receiving the largest
number of votes shall hold office for the term of two years and
the three councilmembers -elect receiving the smallest number of
votes shall hold office for a term of one year; provided,
however, in case of tie vote between two or more candidates whose
terms shall be either one or two years, then the candidates who
are tied shall decide said vote by lot in such way as may be
agreed upon between or among them. Annually thereafter there
shall be elected each year three councilmembers to hold office
for a period of two years, and all elections are to be held in
the manner provided for in Article IX of the Charter of the City
of Baytown, Texas.
Section 3: This ordinance shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
