The City Council of the City of Baytown, Texas met in a Regular Work Session on February 28,
2019, at 5:31 P.M., in the Hullum Conference Room of the Baytown City Hall, 2401 Market
Street, Baytown, Texas with the following in attendance:

Mayor Capetillo convened the February 28, 2019, City Council Regular Work Session with a
quorum present at 5:31 P.M., all members were present with the exception of Council Member
Himsel who was absent.
1. DISCUSSIONS
a. Discuss the City Council Strategies and Implementation Plan FY 2019-2020.
Director of Strategic Initiatives Nick Woolery presented the item and noted that Council had its
retreat some months back and from that information, staff has created a draft implementation
plan that can be distributed to the Council for further review.
Mr. Woolery noted that at this time, staff is looking towards the Council on how to move
forward as it relates to a future retreat to include the staff. He noted that staff anticipates that it
will need an estimated three hours in order to have a good, final discussion for the
implementation plan and give the Council an opportunity to interact with some of the
Department Heads that will participate in many of the implementation goals. He recommended
that Council consider a non -council Thursday or a Friday afternoon, as Saturdays have been very
difficult to schedule.
General Manager Rick Davis noted that in visiting with the Council, the preference is to meet
again on a Thursday or Friday afternoon, with a preference of a non -council Thursday. Mayor
Capetillo suggested that staff pick a Thursday to have said retreat, and while staff may need three
hours, he recommended that the Council have more time to continue its discussion on many of
the items and/or any other item that they may have interest in, which could fit into the strategic

plan, separate and apart from what staff will be presenting. Mayor Capetillo stated that Council
would like to talk about any item that is important to each of them, and wanted to schedule the
entire day, whether it be a Thursday or Friday, to allow for said comments. Mayor Capetillo
noted that he wanted Council to feel comfortable and have an opportunity to add items to the
budget as needed and not after the City Manager had submitted his budget for approval. Council
preferred that the retreat not be held at City Hall and consider another venue; such as, the
Innovation Room or the Evergreen Clubhouse, and requested that department heads that are not
needed, not be made to attend.
Mr. Davis stated that based on the input, staff will look for a Friday afternoon for about five (5)
hours; maybe noon to 5:00 P.M., and have more discussion as needed in the future. He further
noted that the two (2) objectives for the meeting will be: (1) to review the implementation plan
from the last retreat and (2) come together for more discussion so the Council can add new items
or initiatives into the strategic plans as appropriate.
The Council consensus was a meeting on Friday, March 22, 2019, from noon to 5:00 P.M.,
pending Council Member Himsel can attend.
b. Discuss any or all of the agenda items on the City Council Regular Meeting Agenda
for February 28, 2019, which is attached below.
Council Member Presley noted that as it relates to the agenda item on the February 28, 2019,
City Council agenda, related to the fourth amendment to the YoYo, LLC, Economic
Development Agreement and noted that he recommended that the City pay out a portion of the
monies to the YoYo, LLC, and extend the time frame on the agreement to allow them more time
to find commercial tenants before changing the designation of these areas to residential.
Development Manager David Planck stated that the original agreement noted that YoYo, LLC,
was required to create three (3) commercial spaces on the ground floor, and in return the City
would pay -out $75,000, upon the issuance of its certificate of occupancy. The YoYo, LLC,
representative has asked the City to reduce the commercial space by one, which would allow for
at least two and not three, m well as, to reduce the full time employees (FTEs) requirement from
ten (10) employees to five (5).
Mayor Capetillo requested clarification on the criteria for allowing 380 agreements, and would
the recommended changes make a negative on said agreement. City Attorney Ignacio Ramirez,
Sr., noted that 380 Agreements are a tool used to encourage developments that would not
otherwise happen. He noted that in this instance, the developers already had the plan and intent
to build the development in question before they came in and asked for the 380
agreement. Deputy City Manager Ron Bottoms noted that if not for the 380 agreement, the
Developers would not have developed the project in the way the City wanted it developed.
Council Member Presley recommended that the agreement be modified to allow for the
distribution to the developer of a portion of the $75,000, maybe $50,000, and give them an
additional extension of six (6) months to attract the commercial component. Mr. Bottoms

recommended that Council allow staff an opportunity to reach out the developers about
modifications and bring Council some options at a future meeting.
Council Member Betancourth stated that she did not feel Council was ready to make a decision
on this item, and requested that staff go back to the group and find some options for the Council
to consider.
Council directed staff to reach out to the developer on modifications to the agreement, which are
to be brought back to the Council at a future meeting. Mayor Capetillo noted that this item will
likely be suspended to a future meeting to allow staff time to bring back options.
2. ADJOURN
With there being no further business to discuss, Mayor Capetillo adjourned the February 28,
2019, City Council Regular Work Session at 6:20 P.M.
