Ordinance No. 5,986910912-4 ORDINANCE NO. 5986 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THREE THOUSAND SIX HUNDRED SIX AND 80/100 ($3,606.80) DOLLARS TO PAUL KLING & ASSOCIATES FOR THE PUMP IMPELLER ASSEMBLY FOR FIRE UNIT #50; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the pump impeller assembly to Fire Unit #50 has suffered unforeseen damage rendering it out of service; and WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the pump impeller assembly for Fire Unit 150 have been obtained, and Paul Kling & Associates, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Paul Kling & Associates of the sum of THREE THOUSAND SIX HUNDRED SIX AND 80/100 ($3,606.80) DOLLARS for the pump impeller assembly for Fire Unit #50 is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
