ORDINANCE NO. 5986
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THREE
THOUSAND SIX HUNDRED SIX AND 80/100 ($3,606.80) DOLLARS
TO PAUL KLING & ASSOCIATES FOR THE PUMP IMPELLER
ASSEMBLY FOR FIRE UNIT #50; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the pump impeller assembly to Fire Unit #50 has
suffered unforeseen damage rendering it out of service; and
WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the pump impeller assembly for
Fire Unit 150 have been obtained, and Paul Kling & Associates, is
the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Paul Kling & Associates of the
sum of THREE THOUSAND SIX HUNDRED SIX AND 80/100 ($3,606.80)
DOLLARS for the pump impeller assembly for Fire Unit #50 is
hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 12th day of
September, 1991.
