ORDINANCE NO. 5947
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOUR
THOUSAND TWO HUNDRED AND NO 1100 ($4,200.00) DOLLARS TO
GIFFORD HILL AMERICAN, INC. FOR THE REPAIR OF A
SANITARY SEWER FORCE MAIN; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the sanitary sewer force main on Raccoon at Massey
Tompkins Road has failed causing raw sewage to leak; and
WHEREAS, TEX. L. GOV'T. CODE ANN. g 252.022, provides that in
case of procurements for the protection of public health or
safety, the requirement for competitive bids is not applicable;
and
WHEREAS, informal bids for the repair of a sanitary sewer
force main have been obtained, and Gifford Hill American, Inc.,
is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Gifford Hill American, Inc. of
the sum of FOUR THOUSAND TWO HUNDRED AND NO 1100 ($4,200.00)
DOLLARS for the repair of a sanitary sewer force main is hereby
authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
