Ordinance No. 5,941910801 -1 ORDINANCE NO. 5941 AN ORDINANCE AMENDING CHAPTER 8, ARTICLE II "CLASSIFICATION PLAN FOR CLASSIFIED SERVICE" OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS, BY AMENDING APPENDIX "I" OF SAID ARTICLE TO CHANGE THE TITLE OF THE CLASSIFICATION OF THE RANK IMMEDIATELY BELOW THAT OF CHIEF OF POLICE FROM ASSISTANT CHIEF OF POLICE TO CAPTAIN; PRESCRIBING FOR A TOTAL OF FIVE POSITIONS IN THE CAPTAIN CLASSIFICATION; PROVIDING THAT THE TWO EXISTING PERSONS IN THIS CLASSIFICATION RETAIN THE TITLE OF ASSISTANT CHIEF UNTIL THEIR RETIREMENT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown conducted a comprehensive study of the Baytown Police Department; and WHEREAS, said study concluded that in order to strengthen the chain of command, balance command responsibility, and provide the Chief of Police with a broader command staff, the City of Baytown should create three additional positions within the classification immediately below that of Chief of Police, that these three positions should be titled "Captain" and that they should be on an equal rank with the Assistant Chief of Police; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Appendix "I" of Chapter 8, Art. II of "Classification Plan for Classified Service" of the Code of Ordinances, City of Baytown, Texas, is hereby amended by renaming the classification immediately below Chief of Police of the Baytown Police Department from "Assistant Chief of Police" to "Captain." Section 2: That the City Council of the City of Baytown hereby prescribes for a total of five Captain positions in the City of Baytown Police Department. Section 3: That the two existing persons in this classification retain the title of Assistant Chief until their retirement. Section 4: That upon the two existing positions in this classification becoming vacant the positions shall be filled with Captains by testing as provided by Chapter 143 of the Local Government Code. Section 5: That the Captain classification in Appendix I as provided for in Ordinance 560 is hereby repealed to conform with the above classification. 910801 -1A Section 6: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
