Ordinance No. 5,924910711-1 ORDINANCE NO. 5924 1W AN ORDINANCE CREATING THE ENICHEM REINVESTMENT ZONE FOR TAX ABATEMENT PURPOSES PURSUANT TO RESOLUTION NO. 1092 OF THE CITY COUNCIL OF THE CITY OF BAYTOWN; AND MAKING VARIOUS FINDINGS AND PROVISIONS RELATED TO THE SUBJECT. WHEREAS, the creation and retention of job opportunities that bring new wealth is one of the highest civil priorities of the City of Baytown (the "City"); and WHEREAS, EniChem Elastomers Americas, Inc. ( "EniChem") desires to establish a Manufacturing Facility (as defined in Section 1(i) of Resolution No. 1092 of the City Council of the City of Baytown (the "Guidelines and Criteria") for product distribution throughout the United States and for export; and WHEREAS, EniChem has filed a written request for tax abatement in accordance with Section 3 of the Guidelines and Criteria; and WHEREAS, EniChem has represented that it will increase the value of its property by at least Five Million Dollars ($5,000,000.00) after the period of abatement has expired; and WHEREAS, EniChem has represented that it will create employment for at least fifty (50) people on a permanent basis in Harris County; and WHEREAS, the City Council of the City of Baytown (the "City Council") has held a public hearing on July 11, 1991, on the designation of the proposed reinvestment zone to be known as the EniChem Reinvestment Zone (the "proposed zone"); and WHEREAS, the City Council, through its designated officer or employee, has issued a feasibility study setting out the impact of the proposed tax abatement (attached hereto as Exhibit A and made a part hereof for all purposes) and recommends that the proposed zone be created; and WHEREAS, it is reasonably likely that the creation of the proposed zone will contribute to the expansion of primary employment and will attract major investment in the proposed zone that will be a benefit to the property and that will contribute to the economic development of the City; and WHEREAS, the improvements sought to be constructed within the proposed zone are feasible and practicable and will be of benefit to the land to be included within the proposed zone and to the City; NOW THEREFORE 910711 -1a BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS;: Section 1: The City of Baytown hereby establishes and designates a reinvestment zone to be known as the EniChem Reinvestment Zone (referred to below as the "Zone ") for the purpose of encouraging economic development through commercial or industrial tax abatement. This designation shall be effective for five (5) years from the effective date of this ordinance. Section 2: The Zone encompasses approximately 79.245 acres as more particularly described on Exhibit B which is attached hereto and made a part hereof for all purposes. Section 3: This ordinance shall serve as notice to every taxing unit that includes inside its boundaries property that is located, within the boundaries of the Zone, of the establishment of the EniChem Reinvestment 'Zone by the City, and the City Secretary is hereby directed to send certified copies of this Ordinance to all such affected taxing units. Section 4: Should any portion or part of this ordinance be held for any reason to be invalid and unenforceable, the same shall not be construed to affect any other valid portion hereof, but all valid portions hereof shall remain in full force and effect and to this end all provisions of this ordinance are hereby declared to be severable. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council.. The Greater Houston Partnership reports that total economic impact is a function of total payroll times a multiplier of four (4). D. Texas Chemical Council research indicates that chemical service sector jobs are created at a ratio of one (1) for every new chemical manufacturing job. To be conservative a ratio of 3 to 1 was used, accompanied by an assumption that the rate of pay is less than the chcmical worker's pay. E. The chemical manufacturer requests a four (4) yearltax abatement totaling six million dollars. H. Summary: A. Payroll: 1. Full time equivalent annual payroll of $6 million x 4 yrs = $24 million (total direct payroll) 2. Service jobs 33 x $15 thousand x 4 yrs. = $1.98 million (total service payroll) 3.
