ORDINANCE N0. 5923
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO
THOUSAND TWO HUNDRED FIFTY AND N01100 ($2,250.00)
DOLLARS TO DAN'S AIR CONDITIONING COMPANY FOR THE REPAIR
OF THE AIR CONDITIONING UNIT IN THE MUNICIPAL COURT; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the air conditioning unit in the Municipal Court
has experienced unforeseen failure requiring replacement of the
compressor; and
WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the repair of the air
conditioning unit in the Municipal Court have been obtained, and
Dan's Air Conditioning Company, is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Dan's Air Conditioning Company
of the sum of TWO THOUSAND TWO HUNDRED FIFTY AND NO 1100
($2,250.00) DOLLARS for the repair of the air conditioning unit
in the Municipal Court is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 9th day of July,
1991.
