Ordinance No. 5,923910709 -1 ORDINANCE N0. 5923 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND TWO HUNDRED FIFTY AND N01100 ($2,250.00) DOLLARS TO DAN'S AIR CONDITIONING COMPANY FOR THE REPAIR OF THE AIR CONDITIONING UNIT IN THE MUNICIPAL COURT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the air conditioning unit in the Municipal Court has experienced unforeseen failure requiring replacement of the compressor; and WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of the air conditioning unit in the Municipal Court have been obtained, and Dan's Air Conditioning Company, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Dan's Air Conditioning Company of the sum of TWO THOUSAND TWO HUNDRED FIFTY AND NO 1100 ($2,250.00) DOLLARS for the repair of the air conditioning unit in the Municipal Court is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
