ORDINANCE NO. 5902
9A AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THREE
THOUSAND FIVE HUNDRED AND NO 1100 ($3,500.00) DOLLARS TO
NAYLOR SUPPLY CO., INC. AS THE SOLE SOURCE FOR THE
REPAIR OF THE PEABODY MYERS HIGH PRESSURE WATER PUMP ON
THE VACTOR TRUCK, UNIT 6 -6; AND PROVIDING FOR THE
EFFECTIVE DATE THERE'OF'.
WHEREAS, the Peabody Myers high press ire water pump in the
Vactor truck used for correcting sewer problems in the City has
failed; and
WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, the procurement of the repair of the Peabody Myers
high pressure water pump on the Vactor truck, Unit 6 -6, can be
satisfied by only one source, Naylor Supply Co., Inc.; NOW
THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1 That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That the City Council of the City of Baytown,
Texas, hereby declares that only one source can satisfy the needs
of the City for the repair of the Peabody Myers high pressure
water pump on the Vactor truck, Unit 6 -6.
Section 3: That payment to Naylor Supply Co., Inc., as sole
source, of the sum of THREE THOUSAND FIVE HUNDRED AND N01100
($3,500.00) DOLLARS for the repair of the Peabody Myers high
pressure water pump on the Vactor truck, Unit 6 -6, is hereby
authorized.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 21st day of .Tune,
