Ordinance No. 5,894910613 -12 ORDINANCE NO. 5894 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AU'T'HORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND SEVENTY AND 50/100 ($2,070.50) DOLLARS TO DAN'S AIR CONDITIONING FOR THE REPAIR OF AN AIR CONDITIONING UNIT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Community Building air conditioning system unexpectedly developed a freon leak and burned out condenser motors; and WHEREAS, TEX. L. GOV'T. CODE ANN. S 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of an air conditioning unit have been obtained, and Dan's Air Conditioning, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Dan's Air Conditioning of the sum of TWO THOUSAND SEVENTY AND 50/100 ($2,070.50) DOLLARS for the repair of an air conditioning unit is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
