ORDINANCE NO. 5894
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AU'T'HORIZING THE PAYMENT OF THE SUM OF TWO
THOUSAND SEVENTY AND 50/100 ($2,070.50) DOLLARS TO DAN'S
AIR CONDITIONING FOR THE REPAIR OF AN AIR CONDITIONING
UNIT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the Community Building air conditioning system
unexpectedly developed a freon leak and burned out condenser
motors; and
WHEREAS, TEX. L. GOV'T. CODE ANN. S 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the repair of an air conditioning
unit have been obtained, and Dan's Air Conditioning, is the low
bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Dan's Air Conditioning of the
sum of TWO THOUSAND SEVENTY AND 50/100 ($2,070.50) DOLLARS for
the repair of an air conditioning unit is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 13th day of June,
1991.
