ORDINANCE NO. 5856
AN ORDINANCE AWARDING THE CONTRACT FOR COMMUNITY
DEVELOPMENT REHABILITATION PROJECT NO. 90 -07 TO
NOLASCO'S CARPENTRY FOR THE SUM OF SEVENTEEN THOUSAND
THREE HUNDRED SIXTY -FOUR AND N01100 ($17,364.00)
DOLLARS.
WHEREAS, the City of Baytown's Community Development Program
did advertise for bids for Community Development Program
Rehabilitation Project No. 90 -07 to be received April 25, 1991;
and
WHEREAS, notice to all bidders as to the time and place,
when and where the contract would be let was published pursuant
to provisions of Section 74 of the Charter of the City of
Baytown, and
WHEREAS, all bids were opened and publicly read at the
Community Development Office at 10:00 a.m., Thursday, April 25,
1991, as per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of Nolasco's Carpentry for the sum of
SEVENTEEN THOUSAND THREE HUNDRED SIXTY -FOUR AND N01100
($17,364.00) DOLLARS for Community Development Rehabilitation
Project No. 90 -07, being the repair and rehabilitation of 3410
Illinois, providing that final payment will not be made to said
contractor until completion and acceptance of the work by the
owner and the Baytown Community Development Program.
Section 2: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. C 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original contract
price may not be increased by more than ten (10 %) percent or
decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 9th day of May,
1991.

FIELD NOTES FOR
TRUCKSTOPS CORPORATION OF AMERICA
PROPERTY AT S.E. INTERSECTION OF
I -10 AND THOMPSON ROAD
Being a 17.255 acre tract or parcel of land situated in the WILLIAM
HILBUS SURVEY, Abstract No. 336, Harris County, Texas, being out
of Block One, Unit "D" of Elena Fruit and Cotton Farms, a
subdivision in Harris County, Texas, said Block One being the same
land conveyed by General Warranty Deed dated January 16, 1935, to
Clyde M. Harper and recorded in Volume 1001, Page 814 of the Deed
Records of Harris County, Texas, said 17.255 acre tract or parcel
of land herein described being more particularly described by metes
and bounds as follows:
BEGINNING at a 1" iron rod set in the Southeast right -of -way line
of Interstate Highway No. 10 at its intersection with the East
right -of -way line of Thompson Road, said intersection point being
called South 00 °40100" East a distance of 1,137.41 feet from the
Northwest corner of said Block One, Unit "D" of Elena Fruit and
Cotton Farms on the South right -of -way line of Ellis School Road;
THENCE North 33 002149" East with the Southeast right -of -way line of
Interstate Highway No. 10, said line also being the city limit line
of the City of Baytown, a distance of 83.26 feet (called 83.2 feet)
to a 1" iron rod set at a point of intersection in the Southeast
right -of -way line of Interstate Highway No. 10 for a corner of the
herein described tract;
THENCE North 66 °46130" East continuing with the Southeast right -
of -way line of Interstate Highway No. 10, a distance of 669.8 feet
to a point of intersection in the Southeast right -of -way of
Interstate Highway No. 10 for a corner of the herein described
tract from which a concrete highway right -of --way monument bears
South a distance of 0.47 feet and East a distance of 1.19 feet;
THENCE North 53."4613011 East continuing with the Southeast right -
of -way line of Interstate Highway No. 10, a distance of 69.50 feet
to a point of intersection in the Southeast right -of -way of
Interstate Highway No. 10 for a corner of the herein described
tract from which a concrete highway right -of -way monument bears
South a distance of 0.18 feet and East a distance of 1.28 feet;
THENCE North 66 046130" East continuing with the Southeast right -
of -way line of Interstate Highway No. 10, a distance of 261.10 feet
to a 1/2" iron rod found in the Southeast right -of -way line of
Interstate Highway No. 10 at its intersection with the West right -
of -way line of the San Jacinto River Authority Canal 2.675 acre
tract, Federal Works Agency War Public Works, Harris County War
Industries Water Supply, Docket No. Tex 41 -564, Parcel No. E -59E,
said 1/2" iron rod being the Northeast corner of the herein
described tract;

Farms at its intersection with the San Jacinto River Authority
Canal right -of -way, said 1/2" iron rod being the Southeast corner
of the herein described tract;
THENCE South 88 °49' 4711 West along the South line of said Block One,
Unit "D" of Elena Fruit and Cotton Farms and the South line of the
herein described tract, a distance of 1,062.87 feet to a 1/2" iron
rod found at the Southwest corner of said Block One, Unit "D" of
Elena Fruit and Cotton Farms for the southwest corner of the herein
described tract;
THENCE North 00 040100" West with the East right -of -way line of
Thompson Road and the Westerly most line of the herein described
tract, a distance of 482.5 feet (called 480.74 feet) to the POINT
OF BEGINNING, and encompassing an area of approximately 17.255
acres of land.
