Ordinance No. 5,834910411 -11 ORDINANCE NO. 5834 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOUR THOUSAND EIGHT HUNDRED AND N0 1100 ($4,800.00) DOLLARS TO HARE AIR CONDITIONING & HEATING COMPANY FOR THE REPLACEMENT OF A CONDENSING UNIT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the condensing unit at the Planning & Traffic and Community Development building has suffered unforeseen damage; and WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the replacement of a condensing unit have been obtained, and Hare Air Conditioning & Heating Company, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Hare Air Conditioning & Heating Company of the sum of FOUR THOUSAND EIGHT HUNDRED AND N0 1100 ($4,800.00) DOLLARS for the replacement of a condensing unit is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
