ORDINANCE NO. 5834
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOUR
THOUSAND EIGHT HUNDRED AND N0 1100 ($4,800.00) DOLLARS TO
HARE AIR CONDITIONING & HEATING COMPANY FOR THE
REPLACEMENT OF A CONDENSING UNIT; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the condensing unit at the Planning & Traffic and
Community Development building has suffered unforeseen damage;
and
WHEREAS, TEX. L. GOV'T. CODE ANN. § 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the replacement of a condensing
unit have been obtained, and Hare Air Conditioning & Heating
Company, is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Hare Air Conditioning & Heating
Company of the sum of FOUR THOUSAND EIGHT HUNDRED AND N0 1100
($4,800.00) DOLLARS for the replacement of a condensing unit is
hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 11th day of April,
1991.
