Ordinance No. 5,833910411 -10 ORDINANCE NO. 5833 AN ORDINANCE AMENDING CHAPTER 11, "ELECTRICAL CODE ", OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN EFFECTING LICENSING EXAMS AND TECHNICAL REQUIREMENTS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO THOUSAND AND N01100 ($2000.00) DOLLARS FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 11- 2(c)(2) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: Sec. 11 -2. Duty to hold examination; requirements for examinations. (c)(2) Journeyman electrician. (a) Apprentices applying for the journeyman electrician's license who shall have successfully completed an apprenticeship in a four year apprenticeship program which is approved by both the U.S. Board of Apprenticeship and Training and the State of Texas shall be considered to qualify for examination for journeyman electrician's license. (b) Apprentices applying for the journeyman electrician's license who have a minimum of four (4) years electrical experience, shall be considered to qualify for examination for journeyman electrician's license. (c) An applicant for the journeyman electrician's license who can produce, proof of journeyman experience as verified by a county, state or municipal body and a master electrician who has employed him in the past, shall be considered to qualify for examination for journeyman electrician's license. Section 2: That Section 11-73(g) of the Code of Ordinances of the City of Baytown, Texas is hereby amended to read as follows: 910411 -10a Sec. 11 -73 Requirements Enumerated (g) All electrical connections to new installations of central air /heating units, fuel fired appliances, and mechanical equipment shall conform to National Fire Protection Association Code Requirements and shall be provided with the following: (1) A disconnecting means in the ungrounded leads of each power circuit to be installed within sight and within easy reach of each grouping of electrically operated components. Disconnecting means shall be no farther than six (6) feet from the service side of the equipment. (2) A suitable 115 volt outlet at each location described in (1) above. (3) In addition, all new installations of central air /heating units located in attics of residences shall be provided with a twenty -four (24) inch minimum walkway with a minimum of thirty -six (36) inch vertical clearance on the control side of the unit. There shall be a light near the unit with a controlling switch within six (6) feet of stairway and such switch must be readily accessible. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: in setting the amount of the penalty for violation of this Ordinance, the City Council affirmatively finds that this Ordinance governs conduct that poses a serious threat to the fire safety, and that it is therefore appropriate to prescribe a maximum fine of TWO THOUSAND AND N01100 ($2,000.00) DOLLARS for a violation of this Ordinance pursuant to the authority granted by TEX.L. GOV'T.CODE ANN. § 54.001. - 2 - 910411 -10b Section 6: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
