Ordinance No. 5,815Published In: THE BAYTOWN SUN Thursday, April 4, 1991 910321 -1 ORDINANCE NO. 5815 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF THE PROPERTY AT S.E. INTERSECTION OF I -10 AND THOMPSON ROAD; WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS FOR THE CITY OF BAYTOWN, TEXAS. WHEREAS, there being no request for an "on- site" hearing, two public hearings before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the property described in Section 1 of this ordinance, were held, one at 7 :00 p.m. and the other at 7 :15 p.m., on the 28th day of February, 1991, in the City Council Chamber of the City Hall of the City of Baytown, Texas, which date is not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, notices of such public hearings were published in a newspaper having general circulation in the City of Baytown, Texas, and in the below described territory on the 15th day of February, 1991, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearings; and WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1st day of January, 1991, was 29.58 square miles; and WHEREAS, the population of the City of Baytown, Texas, is approximately 63,686 inhabitants; and WHEREAS, the below described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the below described territory lies adjacent to and adjoins the City of Baytown, Texas; NOW THEREFORE, BE IT, ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the following described land and territory lying adjacent to and adjoining the City of Baytown is hereby added and annexed to the City of Baytown, Texas, and shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present boundary limits of such City, at the various points Contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit; SEE EXHIBIT "A" 910321 -1a Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens of the City of Baytown and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Baytown, Texas. Section 3: In accordance with TEX. L.GOV'T.CODE ANN. { 43.056, as amended, the service plan prepared by the City for providing municipal services to the annexed area is attached as Exhibit "B" and is hereby approved. Section 4: This ordinance shall be published and passed in the manner provided in Article 1, Section 9, of the Charter of the City of Baytown, Texas. Public hearings are scheduled for February 28, 1991 at 7:00 pm and 7:15 pm in the City Hall Council Chambers. The annexation will be accomplished from an existing strip of ten feet on the South side of the Interstate 10 right -of- way that is a city limits line. Included as a part of this plan are the location map and field notes for the area. As a result of this proposed annexation, no additional city facilities, vehicles, or personnel will be required. At this time, the property is anticipated to be developed into a major truck service center (truck stop) which will add a significant number of jobs and increase the local tax base. Attached to this summary are the specific Service Plan elements submitted by each of the major city departments.
