Ordinance No. 5,768Published In: THE BAYTOWN SUN Tuesday, February 19, 1991 910214 -3 Wednesday, February 20, 1991 ORDINANCE NO. 5768 AN ORDINANCE AUTHORIZING AND DIRECTING THE REMOVAL OF • SIGNAL DEVICES AT COMMERCE STREET AND WEST STERLING AND COMMERCE STREET AND WEST DEFEE STREET; DESIGNATING COMMERCE STREET AT WEST STERLING AND COMMERCE STREET AT WEST DEFEE STREET AS STOP INTERSECTIONS; AUTHORIZING AND DIRECTING THE PLACEMENT OF STOP SIGNS; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO 1100 ($200.00) DOLLARS FOR EACH VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, pursuant to the provisions of TEX. REV. CIV.STAT. ANN. , art. 6701d, does declare that at the following described intersections there will no longer be signalization, to -wit: Commerce Street and West Sterling Street Commerce Street and West Defee Street Section 2: That the City Council of the City of Baytown, Texas, pursuant to the provisions of TEX.REV.CIV.STAT.ANN., art. 6701d, does declare the following described intersections to be stop intersections, to -wit: Commerce Street at West Sterling Street Commerce Street at West Defee Street Section 3: The Director of Planning and Traffic is hereby authorized to place stop signs at the above - described locations. Section 4: It shall be unlawful for a driver of a vehicle to disobey the instructions of a sign placed in accordance with the provisions of this ordinance, unless at the time otherwise directed by a police officer. Section 5: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 6: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable.
