Ordinance No. 5,765910131 -16 ORDINANCE NO. 5765 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THREE THOUSAND EIGHT HUNDRED FORTY AND N01100 ($3,840.00) DOLLARS TO PARKSON FOR THE PARTS NECESSARY TO REPAIR THE MECHANICAL BAR SCREEN AT THE CENTRAL DISTRICT WASTEWATER TREATMENT PLANT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the mechanical bar screen at the Central District Wastewater Treatment Plant has suffered unforeseen damage, and the loss of this equipment affects the ability of the treatment plant to properly treat wastewater; and WHEREAS, TEX.LOC.GOVIT.CODE ANN. § 252.022, provides that in case of procurements for the protection of public health or safety, or if the procurement is necessary because of unforeseen damage to public machinery or equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the parts necessary to repair this equipment have been obtained, and Parkson is the low bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Parkson of the sum of THREE THOUSAND EIGHT HUNDRED FORTY AND N01100 ($3,840.00) DOLLARS is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
