Ordinance No. 5,733910103 -1 ORDINANCE NO. 5733 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF EIGHT THOUSAND AND N01100 ($8,000.00) DOLLARS TO HOUSTON SERVICE INDUSTRIES FOR REPAIRS TO THE MECHANICAL BAR SCREEN AT THE CENTRAL DISTRICT WASTEWATER TREATMENT PLANT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the mechanical bar screen at the Central District Wastewater Treatment Plant has suffered unforeseen damage, and the loss of this equipment affects the ability of the treatment plant to properly treat wastewater; and WHEREAS, TEX.LOC.GOV'T.CODE ANN. § 252.022, provides that in case of procurements for the protection of public health or safety, or if the procurement is necessary because of unforeseen damage to public machinery or equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the necessary repairs have been obtained, and Houston Services Industries is the low bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Houston Services Industries of a sum not to exceed EIGHT THOUSAND AND N01100 ($8,000.00) DOLLARS is hereby authorized, with the actual amount to be determined after dismantlement of the damaged equipment. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
