Ordinance No. 5,720901213 -13 ORDINANCE NO. 5720 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FIVE THOUSAND SIX HUNDRED SEVENTY -FIVE AND N01100 ($5,675.00) DOLLARS TO COX AIR CONDITIONING FOR THE REPLACEMENT OF A 25 TON COMPRESSOR FOR THE FIRE ADMINISTRATION BUILDING; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the 25 ton compressor for the air conditioning system at the Fire Administration building malfunctioned and overheated to the extent that it cannot be repaired; and WHEREAS, TEX. L.GOV'T.CODE ANN. § 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the replacement of a 25 ton compressor for the Fire Administration Building have been obtained, and Cox Air Conditioning, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Cox Air Conditioning of the sum of FIVE THOUSAND SIX HUNDRED SEVENTY -FIVE AND N01100 ($5,675.00) DOLLARS for the replacement of a 25 ton compressor for the Fire Administration Building is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
