Ordinance No. 5,644C� J • 900927 -8 ORDINANCE 5644 AN ORDINANCE AMENDING CHAPTER 31, "UTILITIES," OF THE CODE OF ORDINANCES TO REVISE TAPPING FEES, AND TO ESTABLISH RATES FOR VOLUME USERS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 31 -65(A) of the Code of Ordinances of the City of Baytown, Texas, is hereby amended to read as follows: Sec. 31 -65. Sewer service charge. (A) Rate schedule: (1) Minimum monthly rate ........................$6.50 (2) Standard rate (per 1,000 gallons in excess of minimum monthly) ..................$1.20 Section 2: That the Code of ordinances, City of Baytown, Texas, is hereby amended by adding a section, to be numbered 31- 65(E), which section reads as follows: (E) Volume users. A sanitary sewer service customer within the corporate limits of the City of Baytown that (1) qualifies for tax abatement under the City's tax abatement policy and (2) uses more than 400,000 gallons of water per day, shall be charged and owe each month a sewer service charge based upon 1) the consumption of water attributed to it as determined by the provisions of this Code relating to water charges, or 2) the actual waste water flow as determined by a metering system approved by the City of Baytown. Such charges shall be applied as follows: (1) If all of the user's water is purchased from the City of Baytown, the sewer service charge shall be $.89 per thousand gallons of water used per month, or $.89 per thousand gallons of waste water delivered to the City if the waste water is metered as provided herein. (2) If the user is not purchasing all of its water from the City of Baytown, the sewer service charge shall be $1.00 per thousand gallons of water used per month, or $1.00 per thousand gallons of waste water delivered to the City if the waste water is metered as provided herein. 900927 -8a Section 3: That Section 31 -67(a) of the Code of Ordinances of the City of Baytown, Texas, is hereby amended to read as • follows: Sec. 31 -67. Sewer tapping fees. (a) The water billing department shall assess and collect a two hundred fifty ($250.00) dollar sewer tap fee for each and every four -inch sewer tap made within the city limits, and shall assess and collect a four hundred ($400.00) dollar sewer tap fee for each and every finished sewer tap made outside the city limits. All other taps (six (6) inches and larger) and other special connections shall be made by a plumbing contractor or, at the City's option, at the estimated actual cost as determined by the utility office manager with consultation of the director of public works or his designee. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall become effective beginning with the first water and sewer billing for the month of October, 1990.
