Ordinance No. 5,639900927 -3 ORDINANCE NO. 5639 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF SIX THOUSAND NINE HUNDRED NINETY AND NO 1100 ($6,990.00) DOLLARS TO AINSWORTH AND COMPANY FOR REPLACEMENT OF THE COOLING TOWER AT THE CITY HALL ANNEX; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Hall Annex's cooling tower used to provide continuing operation of the air conditioning system has suffered unforeseen damage; and WHEREAS, TEX. L.GOV'T.CODE ANN. § 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, .informal bids for replacement of the cooling tower at the City Hall Annex have been obtained, and Ainsworth and Company, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Ainsworth and Company of the sum of SIX THOUSAND NINE HUNDRED NINETY AND N01100 ($6,990.00) DOLLARS for replacement of the cooling tower at the City Hall Annex is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
