ORDINANCE NO. 5639
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF SIX
THOUSAND NINE HUNDRED NINETY AND NO 1100 ($6,990.00)
DOLLARS TO AINSWORTH AND COMPANY FOR REPLACEMENT OF THE
COOLING TOWER AT THE CITY HALL ANNEX; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.
WHEREAS, the City Hall Annex's cooling tower used to provide
continuing operation of the air conditioning system has suffered
unforeseen damage; and
WHEREAS, TEX. L.GOV'T.CODE ANN. § 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, .informal bids for replacement of the cooling tower
at the City Hall Annex have been obtained, and Ainsworth and
Company, is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Ainsworth and Company of the sum
of SIX THOUSAND NINE HUNDRED NINETY AND N01100 ($6,990.00)
DOLLARS for replacement of the cooling tower at the City Hall
Annex is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 27th day of
September, 1990.
