ORDINANCE NO. 5619
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PROVIDING THAT A PORTION OF UTILITY EASEMENT BE
VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE
QUITCLAIMING OF THE CITY'S INTEREST IN SAID PROPERTY;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, there is a portion of a certain dedicated utility
easement which runs along a portion of the east side of Lot 6,
Forest Gate Subdivision; and
WHEREAS, Angel Brothers Development Company, Inc. is the
abutting land owner and has made application that a portion of
such utility easement be discontinued, closed and abandoned as a
utility easement; and
WHEREAS, Angel Brothers Development Company, Inc. has
offered THREE HUNDRED THIRTY -FIVE AN 24/100 ($335.24) DOLLARS for
the value of a portion of the utility easement; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: The portion of the utility easement to be
abandoned is described as a 5.0 foot wide and 153.90 foot long
utility easement. A description of the portion of such utility
easement to be abandoned is attached hereto and marked Exhibit
"A. n
Section 2: That portion of the dedicated utility easement
described above is hereby closed, abandoned, and permanently
vacated as a dedicated utility easement.
Section 3: That the City of Baytown hereby accepts as the
value for such portion of utility easement, payment by Angel
Brothers Development Company, Inc. , of the sum of THREE HUNDRED
THIRTY -FIVE AN 24/100 ($335.24) DOLLARS.
Section 4: That the interest or interests of the City
and /or public in the portion of the above described utility
easement (and as shown in Exhibit "A" attached hereto) is hereby
quitclaimed to the adjacent owner for and in consideration of
exchange for equal or greater value.
Section 5: That the Mayor and City Clerk are hereby
authorized to execute such instruments, if any, necessary for
such abandonment and sale.
Section 6: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.

FIELD NOTES FOR UTILITY EASEMENT
IN LOT 6 FOREST GATE
BEGINNING at the southeast property corner of Lot 6, said point
also being on the north right -of -way line of Forest Gate Drive;
THENCE, westward along the south property line of said tract a
distance of 5.00 feet to a point;
THENCE, northward parallel to and 5.00 feet west of the east
property line of Lot 6 a distance of 153.50 feet to a point;
THENCE, eastward parallel to and 16.00 feet south of the north
property line of said tract a distance of 5.00 feet to a point,
said point also being on the east right -of -way line of Lot 6;
THENCE, southward along the east property line of Lot 6 a
distance of 153.90 feet to a point, said point also being the
POINT OF BEGINNING, and encompassing an area of approximately 770
square feet.
