ORDINANCE NO. 5617
AN ORDINANCE PROVIDING THAT A PORTION OF THE RIGHT -OF-
WAY OF COUNTRY CLUB VIEW BE VACATED, ABANDONED, AND
CLOSED; PROVIDING FOR THE EXCHANGE OF THE CITY'S
INTEREST IN SAID PROPERTY FOR ADDITIONAL RIGHT -OF -WAY
FOR ALAMANCE DRIVE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, there is an extension of the east end of Country
Club View that has not been improved; and
WHEREAS, the owner of the property surrounding this
unimproved extension has requested that it be discontinued,
closed and abandoned; and
WHEREAS, the owner has offered to dedicate a larger tract
for an extension of Alamance Drive to the new connector street
between Baker Road and Rollingbrook Drive; and
WHEREAS, this exchange of rights -of -way will improve the
traffic flow pattern to and from the proposed connector street
between Baker Road and Rollingbrook Drive; and
WHEREAS, the value of the tract offered is greater than that
of the tract to be abandoned; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the portion of Country Club View as
described in attached Exhibit "A" is hereby closed, abandoned and
permanently vacated as a dedicated right -of -way.
Section 2: That the City of Baytown hereby accepts from the
Emmett 0. Hutto, Trust, as payment for the value of such right -
of -way, the dedication of the tract described in Exhibit "B."
Section 3: That the interest or interest of the City and /or
public, if any, in the above described right -of -way (and as shown
in Exhibit "A" attached hereto) is hereby quitclaimed to the
adjacent owner, the Emmett 0. Hutto, Trust, for and in
consideration of the above dedication.
Section 4: That the Mayor Pro Tempore and City Clerk are
hereby authorized to execute such instruments, if any, necessary
for such abandonment and sale.
Section 5: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.

FIELD NOTES: A PORTION OF COUNTRY CLUB VIEW TO BE VACATED
BEING a tract of land out the Harvey Whiting Survey, Abstract 840, Harris
County, Texas, and being a part of that certain 60.000 acre tract conveyed by
Baytown 31, Limited to Emmett 0. Hutto, Trust, by deed recorded under County
Clerk's File No. G 283945 of the Deed Records, Harris County, Texas, also being
out of that tract of land dedicated to public use for a public street by deed
recorded on Film Code 005 -76 -1058, or County Clerk's File No. J 874762 of the
Deed Records of Harris County, Texas, and being more particularly described by
metes and bounds as follows:
COMMENCING at the Northeast corner of Lot 27, Country Club Oaks, Section
Eight as recorded in Vol. 316, Page 132, of the Map Records of Harris
County, Texas, said point also being located in the South right -of -way
line of Country Club View (based on a 50 foot right -of -way);
THENCE North 89 °26'43" East along said South right -of -way line of Country
Club View a distance of 90.43 feet to the POINT OF BEGINNING and the
beginning of a curve to the left;
THENCE along the arc of said curve to the left having a radius of 75.00
feet, a central angle of 89 °39'06 ", a chord bearing of North 44 °37'11"
East, a chord length of 105.74 feet, a curvilinear distance of 117.35
feet, and a tangent length of 74.55 feet to the point of tangency;
THENCE North 00 °12'22" West a distance of 5.49 feet to the beginning of a
curve to the right, located in the East right -of -way line of Green Tee
