Ordinance No. 5,601900823 -2 ORDINANCE NO. 5601 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND NINE HUNDRED THIRTY -EIGHT AND NO 1100 ($2,938.00) DOLLARS TO COX AIR CONDITIONING FOR THE REPLACEMENT OF A 7 1/2 TON AIR CONDITIONING CONDENSER UNIT FOR THE STERLING MUNICIPAL LIBRARY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Sterling Municipal Library's 7 1/2 ton air conditioning condenser unit has suffered unforeseen damage; and WHEREAS, TEX. L.GOV'T.CODE ANN. § 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the replacement of a 7 1/2 ton air conditioning condenser unit for the Sterling Municipal Library have been obtained, and Cox Air Conditioning, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Cox Air Conditioning of the sum of TWO THOUSAND NINE HUNDRED THIRTY -EIGHT AND N01100 ($2,938.00) DOLLARS for the replacement of a 7 1/2 ton air conditioning condenser unit for the Sterling Municipal Library is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
