ORDINANCE NO. 5601
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO
THOUSAND NINE HUNDRED THIRTY -EIGHT AND NO 1100
($2,938.00) DOLLARS TO COX AIR CONDITIONING FOR THE
REPLACEMENT OF A 7 1/2 TON AIR CONDITIONING CONDENSER
UNIT FOR THE STERLING MUNICIPAL LIBRARY; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the Sterling Municipal Library's 7 1/2 ton air
conditioning condenser unit has suffered unforeseen damage; and
WHEREAS, TEX. L.GOV'T.CODE ANN. § 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the replacement of a 7 1/2 ton
air conditioning condenser unit for the Sterling Municipal
Library have been obtained, and Cox Air Conditioning, is the low
bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Cox Air Conditioning of the sum
of TWO THOUSAND NINE HUNDRED THIRTY -EIGHT AND N01100 ($2,938.00)
DOLLARS for the replacement of a 7 1/2 ton air conditioning
condenser unit for the Sterling Municipal Library is hereby
authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 23rd day of August,
1990.
