ORDINANCE NO. 5592
AN ORDINANCE APPROVING THE SETTLEMENT OF A TAX CLAIM
AGAINST THE FAIR, INC.; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the City of the City of Baytown, Texas, filed a
delinquent tax claim in the bankruptcy proceeding of the Fair,
Inc., Case No. 89- 05617- H2 -11, in the U. S. Bankruptcy Court for
the Southern District of Texas, Houston Division; and
WHEREAS, the City and the Fair, Inc. have agreed that if the
City waives $482.90 in penalty and interest, the City's personal
property tax claim of $4,390.00 will be allowed as a Class 3
priority pre - petition tax claim; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City of Baytown agrees to waive the sum
of FOUR HUNDRED EIGHTY -TWO AND 90/100 ($482.90) DOLLARS due as
penalty and interest on account numbers 9905 - 017 -910 -0 an
9905 -017 -910 -1 in return for the tax amount of FOUR THOUSAND
THREE HUNDRED NINETY AND N01100 ($4,390.00) DOLLARS due under
these account numbers being allowed as a class 3 priority pre -
petition tax claim.
Section 2: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 26th day of July,
1990.
