Ordinance No. 5,59290072E-6 ORDINANCE NO. 5592 AN ORDINANCE APPROVING THE SETTLEMENT OF A TAX CLAIM AGAINST THE FAIR, INC.; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of the City of Baytown, Texas, filed a delinquent tax claim in the bankruptcy proceeding of the Fair, Inc., Case No. 89- 05617- H2 -11, in the U. S. Bankruptcy Court for the Southern District of Texas, Houston Division; and WHEREAS, the City and the Fair, Inc. have agreed that if the City waives $482.90 in penalty and interest, the City's personal property tax claim of $4,390.00 will be allowed as a Class 3 priority pre - petition tax claim; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City of Baytown agrees to waive the sum of FOUR HUNDRED EIGHTY -TWO AND 90/100 ($482.90) DOLLARS due as penalty and interest on account numbers 9905 - 017 -910 -0 an 9905 -017 -910 -1 in return for the tax amount of FOUR THOUSAND THREE HUNDRED NINETY AND N01100 ($4,390.00) DOLLARS due under these account numbers being allowed as a class 3 priority pre - petition tax claim. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
