Ordinance No. 5,926910711-3 ORDINANCE NO. 5926 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH ROBERT M. STEIN AND JOHN R. ALFORD FOR TECHNICAL ASSISTANCE FOR THE ANALYSIS OF ALTERNATE VOTING PLANS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT' ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the Mayor and City Clerk of the City of Baytown to execute and attest to an agreement with Robert M. Stein and John R. Alford for technical assistance for the analysis of alternative voting plans. A copy of said agreement is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. Q1R1-1M`I<R:EZ, Sft,,� City Attorney C :1:69 :1 AGREEMENT STATE OF TEXAS § COUNTY OF HARRIS § The City of Baytown, Texas, hereafter called City of Baytown, and Robert M. Stein and John R. Alford, hereafter called the Contractor, agree as follows: 1) The Contractor agrees to provide the City of Baytown with an analysis of three alternative plans for the size of City Council. The analysis will evaluate each plan for compliance with the U.S. Justice Department's standards for: a. One person one vote requirement b. Majority minority district composition C. Compactness of district boundaries d. Contiguity of district boundaries 2) The Contractor will provide the City of Baytown a listing of census blocks included in each proposed City district. This data wilt include information on the ethnic and racial makeup of each district and census block for total population and adult population. 3) The Contractor will provide a map delineating the district boundaries for each proposed plan. 4) All information gathered and compiled by Contractor pursuant to the services rendered under this contract are property of the City of Baytown. 5) Contractor will be compensated a total of $6,000 for items specified in sections (1) - (3) above, payable as follows: $1,500 payable to Robert M. Stein upon execution of this agreement. $2,250 payable delivery of items (3) . to Robert M. Stein upon specified in sections (1) - $2,250 payable to John R. Alford upon delivery of items specified in sections (1) - (3) . i t "T • � 0 6) The Contractor agrees to evaluate alternative proposals resulting the public hearing process at the request of the City of Baytown. a. Where the City of Baytown provides census block lists for an alternative district plan, the Contract will provide items specified in sections (1) - (3) above at the following rate of compensation: $600 per alternative district proposal. b. Where the City of Baytown does not provide census block lists for an alternative district plan, The Contractor will provide items specified in sections (1) - ( 3 ) above at the following rate of compensation: $650 per alternative district proposal. 7) Payment for analysis of alternative district plans that might result from the public hearing process will be made as follows: a. Where the City of Baytown provides census block lists for an alternative district: $300 per proposal to Robert M. Stein within 30 days of delivery of items specified in sections (1) - (3) above. $300 per proposal to John R. Alford within 30 days of delivery of items specified in sections (1) - (3) above. b. Where the City of Baytown does not provide census block lists for an alternative district: $325 per proposal to Robert M. Stein within 30 days of delivery of items specified in sections (1) - (3) above. $325 per proposal to John R. Alford within 30 days of delivery of items specified in sections (1) - (3) above. 8) All work will be completed with fifteen (15) calendar days of submission by the City of Baytown to the Contractor of specific plans to be evaluated. - 2 - 9) Any additional services requested by the City of • Baytown and agreed to by the Contractor will be billed separately at an hourly rate of $150.
