Ordinance No. 5,573900628 -13 ORDINANCE NO. 5573 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THREE THOUSAND NINE HUNDRED NINETY -FIVE AND N01100 ($3,995.00) DOLLARS TO YOUNG PLUMBING AND AIR CONDITIONING COMPANY, INC. FOR THE EMERGENCY REPLACEMENT OF CARRIER BLOWER ASSEMBLY AT CITY HALL; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Carrier blower assembly used for City Hall air conditioning has suffered unforeseen damage; and WHEREAS, TEX. L.GOV'T.CODE ANN. section 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the emergency replacement of Carrier blower assembly at City Hall have been obtained, and Young Plumbing and Air Conditioning Company, Inc., is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Young Plumbing and Air Conditioning Company, Inc. of the sum of THREE THOUSAND NINE HUNDRED NINETY -FIVE AND N01100 ($3,995.00) DOLLARS for the emergency replacement of Carrier blower assembly at City Hall is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
