Ordinance No. 5,569ORDINANCE NO. 5569 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THREE THOUSAND SIX HUNDRED AND N01100 ($3,600.00) DOLLARS TO BIO -STAR, INC. FOR HAULING SLUDGE FROM PINEHURST PLANT TO CENTRAL PLANT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Pinehurst Treatment Plant is experiencing a sludge overload and excessive waste discharge into Cedar Bayou, necessitating that such excess sludge be removed for the protection of public health and safety; and WHEREAS, TEX. LOC. GOV'T. CODE ANN. section 252.022, provides that in case of procurements for the protection of public health or safety, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for hauling sludge from Pinehurst Plant to Central Plant have been obtained, and Bio -Star, Inc. is the low bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Bio -Star, Inc. of the sum of THREE THOUSAND SIX HUNDRED AND N01100 ($3,600.00) DOLLARS for hauling sludge from the Pinehurst Plant to the Central Plant is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
