ORDINANCE NO. 5560
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THREE
THOUSAND SIX HUNDRED FIFTY AND N01100 ($3,650.00)
DOLLARS TO WENDELL'S TRANSMISSION FOR THE EMERGENCY
REPLACEMENT OF TRANSMISSION ON FIRE TRUCK UNIT #50; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the Fire Department's Fire Truck Unit #50 has
suffered unforeseen damage; and
WHEREAS, TEX. L.GOV'T.CODE ANN., section 252.022, provides
that in case of unforeseen damage to public machinery, equipment,
or other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the emergency replacement of
transmission on Fire Truck Unit #50 have been obtained, and
Wendell's Transmission, is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Wendell's Transmission of the
sum of THREE THOUSAND SIX HUNDRED FIFTY AND N01100 ($3,650.00)
DOLLARS for the emergency replacement of transmission on Fire
Truck Unit #50 is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 13th day of June,
1990.
