ORDINANCE NO. 5517
AN ORDINANCE AMENDING ORDINANCE NO. 899 TO EXCLUDE
CERTAIN AREAS LOCATED WITHIN THE EXTRATERRITORIAL
JURISDICTION OF THE CITY OF BAYTOWN FROM INDUSTRIAL
DISTRICT NO. 3; PROVIDING A REPEALING CLAUSE; CONTAINING
A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, the City Council of the City of Baytown adopted
Resolution No. 1015 setting forth an Industrial District Policy
for the City of Baytown on March 24, 1988; and
WHEREAS, in accordance with the Industrial District Policy
set forth in Resolution No. 1015, certain portions of Industrial
District No. 3 have been annexed to the City of Baytown and are
no longer within Industrial District No. 3 and as such, should be
deleted from the provisions of Ordinance No. 899 adopted the 26th
day of October, 1967, designating a part of the City of Baytown's
extraterritorial jurisdiction as Baytown Industrial District
No. 3; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the hereinafter described incorporated
areas (described in Exhibit "A," attached hereto and made a part
hereof for all intents and purposes) are hereby deleted from
Industrial District No. 3.
Section 2: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 3: If any provisions, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.

Legal Description
BEGINNING at point on the existing city limit line of the City of Baytown, said
point also being in the East right-of-way line of State Highway 146, and said
point also being the northwestern corner of Abbe Subdivision,
THENCE, westward along the existing city limit line of the City of Baytown to
its intersection with the west right-of-way line of State Highway 146,
THENCE, southward along the west right-of-way line of State Highway 146 to its
intersection with the northeast right-of-way line of the Southern Pacific
Railroad Company (formerly T&NO RR Co.), said intersection also being on the
existing city limit line of the City of Baytown,
THENCE, southeastward along the northeast right-of-way line of Southern Pacific
Railroad Company to its intersection with the East right-of-way line of State
Highway 146,
THENCE, northward along the East right-of-way line of State Highway 146 to the

BEGINNING at a point located at the intersection of the West right-
of-way line of State Highway 146 and the westerly bank of Cedar
Bayou, said point also being on the existing Baytown city limit
line;
THENCE, southwestward along the West right-of-way line of State
Highway 146 and along the existing Baytown city limit line to the
intersection with the South right-of-way line of Tompkins Road;
THENCE, North 57 deg 15 min West along the South right-of-way line
of Tompkins Road a distance of approximately 350.00 feet to a
point, said point being the northernmost corner of Tract C-26 in
the Christian Smith Survey, of Harris County, Texas, as described
by the tax records of the City of Baytown;
