Ordinance No. 5,444900125 -2 ORDINANCE NO. 5444 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THIRTY - FOUR THOUSAND TWO HUNDRED TWENTY AND N01100 ($34,220.00) DOLLARS TO TRIANGLE REHAB, INC. FOR THE SLIPLINING OF THE SANITARY SEWER LINE IN THE EASEMENT BETWEEN BURNING TREE AND ST. ANDREWS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the sanitary sewer line in an easement between Burning Tree and St. Andrews has suffered unforeseen damage, in that an 8 inch concrete sewer line has failed, which is causing a potential health hazard; and WHEREAS, TEX.L.GOV'T.CODE ANN. 5 252.022 provides that in case of unforeseen damage to public property, or when a procurement is necessary to preserve or protect the public health or safety of the citizens of the City, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the sliplining of this sewer line have been obtained, and Triangle Rehab, Inc. is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Triangle Rehab, Inc. of the sum of THIRTY -FOUR THOUSAND TWO HUNDRED TWENTY AND N0 1100 ($34,220.00) DOLLARS for this sliplining work is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
