ORDINANCE NO. 5444
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF THIRTY -
FOUR THOUSAND TWO HUNDRED TWENTY AND N01100 ($34,220.00)
DOLLARS TO TRIANGLE REHAB, INC. FOR THE SLIPLINING OF
THE SANITARY SEWER LINE IN THE EASEMENT BETWEEN BURNING
TREE AND ST. ANDREWS; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the sanitary sewer line in an easement between
Burning Tree and St. Andrews has suffered unforeseen damage, in
that an 8 inch concrete sewer line has failed, which is causing a
potential health hazard; and
WHEREAS, TEX.L.GOV'T.CODE ANN. 5 252.022 provides that in
case of unforeseen damage to public property, or when a
procurement is necessary to preserve or protect the public health
or safety of the citizens of the City, the requirement for
competitive bids is not applicable; and
WHEREAS, informal bids for the sliplining of this sewer line
have been obtained, and Triangle Rehab, Inc. is the low bid; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Triangle Rehab, Inc. of the sum
of THIRTY -FOUR THOUSAND TWO HUNDRED TWENTY AND N0 1100
($34,220.00) DOLLARS for this sliplining work is hereby
authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 25th day of
January, 1990.
