Ordinance No. 5,4010 ORDINANCE NO. 5401 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby approves three contracts with the three Baytown Volunteer Fire Fighters' Stations and authorizes and directs the City Manager and City Clerk of the City of Baytown to execute and attest to each contract for fire fighting assistance. A copy of each contract is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2® The City Council hereby authorizes payment of FIVE THOUSAND ONE HUNDRED AND NO/100 ($5,100.00) DOLLARS to the three Baytown Volunteer Fire Fighters' Stations for fire fighting assistance. STRONG, e Attorney �ACNDAL—LB STRY Ci NOMIRIM THE STATE OF TEXAS 5 • § AGREEMENT COUNTY OF HARRIS 9 THIS AGREEMENT is made and entered into by and between the CITY OF BAYTOWN, a municipal corporation, hereinafter called "CITY," and BAYTOWN VOLUNTEER FIRE FIGHTERS STATION 2, hereinafter called "VOLUNTEER." • W I T N E S S E T H: WHEREAS, the Baytown Volunteer Fire Fighters Station 2 have been organized to assist in fire fighting in Baytown and the area covered by contract between Harris- County and the City of Baytown; and WHEREAS, the City Council of the City of Baytown has determined that a program which provides assistance in fire fighting to the Baytown Fire Department is in the public interest; NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That in consideration of the mutual covenants, agreements, and benefits to both parties, it is agreed as follows: • VOLUNTEER agrees each two hours long 6243e.3 and to assist needed. VOLUNTEER wi and to pay any expenses I to hold a minimum of two drills per month as provided by TEX.REV.CIV.STAT.ANN. art. the Baytown Fire Department in fires when 11 be required to provide its own supplies incurred by its members. II The CITY will, however, provide used bunker gear, if it has any available, for use by VOLUNTEER. If the CITY does not have any used bunker gear available, VOLUNTEER will be responsible for purchasing its own bunker gear for its members. Volunteer further agrees to share any extra bunker gear it may have with other Baytown Volunteer Fire Fighters Stations which contract with the CITY for fire fighting assistance. The CITY further agrees to provide radios and repair service for such radios for VOLUNTEER. III The CITY agrees to pay to the VOLUNTEER, the lump sum of ONE THOUSAND SEVEN HUNDRED AND N0 1100 ($1,700.00) DOLLARS for service to be rendered in the development, organization, supervision, and management of this service. Payment shall be made within fifteen days of the City's receipt of the proposed budget and current financial statement described in Section V of this agreement. Nothing herein shall prohibit VOLUNTEER from requesting additional funds for specific additional purposes during the term of this agreement. Such request may be made only if VOLUNTEER has spent all of its funds, including reserves, on expenses fib " j w A • appropriate to volunteer fire fighting. VI In performance of the services agreed to herein, VOLUNTEER agrees to observe and strictly comply with all the terms, conditions, rules, and regulations of all applicable federal, state and city statutes. VII The City Council reserves the right to cancel this contract in the event the services performed by VOLUNTEER hereunder are unsatisfactory in the judgment of the City Council, and further for the violation of any provisions hereof.
