ORDINANCE No. 5329
AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR THE
PUBLIC HEARINGS ON THE PROPOSED ANNEXATION OF THE
WHATABURGER PROPERTY AT 5151 INTERSTATE 10 AT GARTH
ROAD; DIRECTING THE PREPARATION OF A SERVICE PLAN;
AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH
NOTICE OF SUCH PUBLIC HEARINGS; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: On the 14th day of September, 1989, at 7 :00
o'clock p.m. and at 7:15 o'clock p.m., in the City Council
Chambers of the City Hall of Baytown, Texas, the City Council
will hold public hearings giving all interested parties the right
to appear and be heard on the proposed annexation by the City of
Baytown, Texas, of the property described in Exhibit "A" which is
attached hereto and made a part hereof for all intents and
purposes.
Section 2: In compliance with TEX.L.GOV'T.CODE ANN.
§ 43.056, as amended, the Planning Department is hereby directed
to prepare a service plan that provides for the extension of
municipal service into the area described in Exhibit "A ".
Section 3: The City Clerk of the City of Baytown is hereby
authorized and directed to cause notice of each public hearing to
be published once in the newspaper having general circulation in
the City and in the above described territory not more than
twenty (20) days nor less, than ten (10) days prior to the date of
each public hearing, all in accordance with TEX.L.GOV'T.CODE ANN.
E 43.052.
Section 4: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 24th day of August,
1989.

Whataburger Annexation Description
Beginning at a point on the north right -of -way line on Interstate 10
approximately 240 feet east of the centerline of Garth Road, said point
being on the existing corporate limits of the City of Baytown, and said
point also being the southwest corner of a tract of land owned by
Whataburger, Inc.,
Thence, N 08° 29116" W a distance of 210.00 feet to a point,
Thence, S 800 15119" W a distance of 200.00 feet to a point on the east
right -of -way line of Garth Road,
Thence, N 080 29116" W a distance of 25.00 feet along the east right -
of -way line of Garth Road to a point,
Thence, N 801 15119" E a distance of 335.00 feet to a point, said point
being the northeast corner of said tract,
Thence, S 080 29116" E a distance of 235.00 feet to a point on the
north right -of -way line of Interstate 10, said point also being the
southeast corner of said tract,
Thence, S 806 15119" W a distance of 135.00 feet along the north right -
of -way line of Interstate 10 to the point of beginning, and encompassing an
area of 0.84288 acres, more or less.
