ORDINANCE NO. 5297
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWELVE
THOUSAND FORTY AND N01100 ($12,040.00) DOLLARS TO
SUGARLAND REHAB, INC. FOR THE EMERGENCY SANITARY SEWER
SLIPLINING ON MONTANA STREET; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the sanitary sewer line on Montana Street has
collapsed and necessitates the emergency sliplining of the
sanitary sewer line, thus keeping the sanitary sewer system in
operation and protecting public health; and
WHEREAS, TEX.LOC.GOV'T.CODE ANN. 5 252.022, provides that in
case of procurements for the protection of public health or
safety, the requirement for competitive bids is not applicable;
and
WHEREAS, informal bids for the emergency sliplining of a
collapsed sewer line on Montana Street have been obtained, and
Sugarland Rehab, Inc. is the low bidder; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Sugarland Rehab, Inc. of the
sum of TWELVE THOUSAND FORTY AND N01100 ($12,040.00) DOLLARS is
hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 13th day of July,
1989.
