Ordinance No. 5,286ORDINANCE NO. 5286 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOUR THOUSAND SIX HUNDRED SEVENTY -FIVE AND N01100 ($4,675.00) DOLLARS TO YOUNG PLUMBING AND HEATING COMPANY FOR THE EMERGENCY PURCHASE OF A COMPRESSOR FOR STERLING MUNICIPAL LIBRARY'S AIR CONDITIONING SYSTEM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the compressor for Sterling Municipal Library's air conditioning system has suffered unforeseen damage; and WHEREAS, TEX.L.GOV'T.CODE ANN. 5 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the emergency purchase of a compressor for Sterling Municipal Library's air conditioning system have been obtained, and Young Plumbing and Heating Company, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Young Plumbing and Heating Company of the sum of FOUR THOUSAND SIX HUNDRED SEVENTY -FIVE AND N01100 ($4,675.00) DOLLARS for the emergency purchase of a compressor for Sterling Municipal Library's air conditioning system is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
