AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOUR
THOUSAND SIX HUNDRED SEVENTY -FIVE AND N01100 ($4,675.00)
DOLLARS TO YOUNG PLUMBING AND HEATING COMPANY FOR THE
EMERGENCY PURCHASE OF A COMPRESSOR FOR STERLING
MUNICIPAL LIBRARY'S AIR CONDITIONING SYSTEM; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the compressor for Sterling Municipal Library's air
conditioning system has suffered unforeseen damage; and
WHEREAS, TEX.L.GOV'T.CODE ANN. 5 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the emergency purchase of a
compressor for Sterling Municipal Library's air conditioning
system have been obtained, and Young Plumbing and Heating
Company, is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Young Plumbing and Heating
Company of the sum of FOUR THOUSAND SIX HUNDRED SEVENTY -FIVE AND
N01100 ($4,675.00) DOLLARS for the emergency purchase of a
compressor for Sterling Municipal Library's air conditioning
system is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 8th day of June,
1989.
