Ordinance No. 5,268B90523-1 ORDINANCE NO. 5268 AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON THE 3RD DAY OF JUNE, 1989, FOR THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT LARGE, A COUNCILMAN FROM THE CITY AT LARGE, AND TWO COUNCILMEN FROM DISTRICTS NOS. 3 AND 4; PROVIDING FOR THE ELECTION OF OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR A SPECIAL CANVASSING BOARD FOR ABSENTEE BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. WHEREAS, on the 20th day of May, 1989, the Regular Municipal Election of the City of Baytown was held for the purposes of electing a Mayor from the City at large, one Councilman at large, and five Councilmen from the respective five districts 1, 2, 3, 4, and 5, and the returns of said election having been duly made by the Election officials and the City Council having canvassed said returns and determined the results of said Election on this 23rd day of May, 1989; and WHEREAS, it is determined from the canvassing of said returns that no candidate for Mayor, Councilman at large, Councilman from District 3, and Councilman from District 4 received a majority of the votes cast at the regular election for the office of which they were candidates, and accordingly, pursuant to Section 94 of Article IX of the Charter of the City of Baytown, it is the duty of the City Council to order a Special Election for the purposes of submitting to a vote of the qualified voters of said City, the names of the two eligible candidates receiving the highest number of votes at the regular election for each of those offices in order that the voters may designate and elect one of the two candidates in each office; and WHEREAS, in ordering such Special Election, it is the duty of the City Council to determine the eligibility of the candidates whose names are to appear on the ballot for said election; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby finds, determines, and declares that as determined by the canvass of the election returns this day accomplished by the City Council, the two eligible candidates receiving the highest number of votes for the office of Mayor are Emmett 0. Hutto and A. Jean Shepherd. Section 2: That the City Council of the City of Baytown hereby finds, determines, and declares that as determined by the canvass of the election returns this day accomplished by the City 890523 -1a Council, the two eligible candidates receiving the highest number of votes for the office of Councilman at large are Pete C. Alfaro and Fred T. Philips. Section 3: That the City Council of the City of Baytown hereby finds, determines, and declares that as determined by the canvass of the election returns this day accomplished by the City Council, the two eligible candidates receiving the highest number of votes for the office of Councilman from District No. 3 are Bobby J. Credille and Dorothy Tyrrell Harrison. Section 4: That the City Council of the City of Baytown hereby finds, determines, and declares that as determined by the canvass of the election returns this day accomplished by the City Council, the two eligible candidates receiving the highest number of votes for the office of Councilman from District No. 4 are Jimmy Johnson and Michael E. Turner. Section 5: That a Special Election of the City of Baytown, as provided in Section 94, Article IX of the Charter of said City, shall be held between the hours of 7:00 o'clock a.m. and 7 :00 o'clock p.m. on the 3rd day of June, 1989, in said City for the purpose of electing a Mayor from the City at large, a Councilman at large, a Councilman for District No. 3, and a Councilman for District No. 4 from the candidates listed as follows: MAYOR (FROM CITY AT LARGE Emmett 0. Turner Section 8: Each qualified voter who desires to cast an absentee vote shall be entitled to an official ballot and the right to cast such ballot in accordance with the provisions of the Texas Election Code. Section 9: The City Council Chamber and Conference Room area in City Hall of the City of Baytown, 2401 Market Street is hereby established as the Central Counting Station to receive and tabulate voted ballots. The City Clerk is hereby appointed Manager of the Central Counting Station and also Tabulation Supervisor. Ron Embry is hereby appointed Presiding Judge for the Central Counting Station. Section 10: There is hereby created an Absentee Ballot Board which shall count all absentee ballots. Rayborn Johnson is hereby appointed Presiding Judge of the Absentee Ballot Board. 890523 -1e Section 11: The Mayor is hereby directed to give notice of said election by publishing a copy of the Election Proclamation and Notice in a newspaper of general circulation within said City; said publication to be made in accordance with the Texas Election Laws. Section 12: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
