ORDINANCE N0. 5266
AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE,
AND CLOSING A PORTION OF CASEY ROAD, ADJACENT TO BLOCK 3
IN CASEY ADDITION SUBDIVISION, ACCORDING TO THE MAP OR
PLAT THEREOF RECORDED IN VOLUME 532, PAGE 27, OF THE
DEED RECORDS OF HARRIS COUNTY, TEXAS; ABANDONING AND
QUITCLAIMING ALL INTEREST OF THE CITY OF BAYTOWN AND THE
PUBLIC IN AND TO SAID PORTION OF SAID STREET; AND
AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO
ATTEST AND DELIVER A CONVEYANCE TO THE ABUTTING OWNERS.
WHEREAS, the following described portion of Casey Road,
adjacent to Block 3 of Casey Addition Subdivision, lying within
the corporate limits of the City of Baytown in Harris County,
Texas, according to the Map or Plat thereof recorded in Volume
532, Page 27, of the Deed Records of Harris County, Texas, is not
now used by the Public:
TRACT I
A parcel of land described as follows:
BEGINNING at the southeast corner of Lot 12, Block 3,
of the Casey Addition Subdivision in Baytown, Harris
County, Texas;
THENCE in a westerly direction 300 feet along the north
right -of -way line of Casey Road to the Southwest corner
of Lot 7, Block 3, Casey Addition Subdivision;
THENCE in a southerly direction perpendicular to the
right -of -way line of Casey Road a distance of 50 feet
to the south right -of -way line of Casey Road;
THENCE in an easterly direction 300 feet along the
south right -of -way line of Casey Road to its
intersection with an extension of the east lot line of
Lot 12, Block 3 across Casey Road;
THENCE 50 feet in a northerly direction along an
extension of such east lot line of Lot 12, Block 3, to
the POINT OF BEGINNING, being a tract of approximately
15,000 square feet.
WHEREAS, no interest of the public requires that said
portion of said street be improved or kept open; and

WHEREAS, the interest of the public will be benefited by the
termination of any obligation on the part of the City of Baytown
to maintain said portion of said street as a public right -of --way;
and
WHEREAS, the only known owners of property abutting or
adjoining the above described portion of said street have made
application that same be discontinued, closed and abandoned; and
WHEREAS, it appears to be to the best interest of the City
of Baytown, Harris County, Texas, that the above described
portion of said street be discontinued, closed and abandoned, and
that the dedications made in connection with said map or plat of
Casey Addition Subdivision of record aforesaid, be cancelled and
held for naught insofar as the same apply to and affect the above
described portion of said street, and it further appears that the
interest of no other owners of property in said Casey Addition
Subdivision or of the Public in general will be prejudiced or
impaired thereby; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the above described portion of Casey Road
in the Casey Addition Subdivision, lying within the corporate
limits of the City of Baytown, Harris County, Texas, according to
the map or plat thereof recorded in Volume 532, Page 27, of the
Map Records of Harris County, Texas, be and the same is hereby
discontinued and abandoned for Public use, and the City of
Baytown does for itself and for the Public abandon and quitclaim
all interest in and to the above described portion of said
street, and does hereby approve the application of said owners of
the property abutting said portion of said street.
Section 2: That the Mayor of the City of Baytown is hereby
authorized and directed to execute and the City Clerk to attest
and deliver and appropriate conveyance of said portion of Casey
Road to the owner or owners of property abutting same, upon
receipt of proper compensation.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 11th day of May,
1989.
